Kajian Viktimologi Terhadap Anak Korban Perundungan Fisik (Studi Di Polres Serdang Bedagai)

Abstract

Penelitian tesis ini berjudul Kajian Viktimologi Terhadap Anak Korban Perudungan Fisik (Studi Di Polres Serdang Bedagai). Rumusan masalahnya yakni (1) Bagaimana bentuk perlindungan hukum bagi anak akibat dari korban perundungan fisik? (2) Bagaimana upaya Polres Serdang Bedagai dalam menanggulangi kasus anak korban perundungan fisik? (3) Apa kendala yang dihadapi Polres Serdang Bedagai dalam menanggulangi kasus anak korban perundungan fisik? Penelitian ini bertujuan Untuk mengkaji dan menganalisis bentuk perlindungan hukum anak korban perundungan fisik ditinjau dari aspek viktimologis. Metode penelitian ini menggunakan metode penelitian yuridis normatif. Teknik pengumpulan datanya berupa wawancara, dan studi pustaka. Hasil penelitian menunjukkan bahwa (1) bentuk perlindungan hukum bagi anak korban perundungan fisik yakni perlindungan hukum berdasarkan Kitab Undang-Undang Nomor 35 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak. (2) Upaya Polres Serdang Bedagai Dalam menaggulangi Kasus Anak Korban Perundungan Fisik yakni melakukan penyuluhan, melakukan Kerjasama dengan Lembaga – Lembaga perlindungan anak, melakukan upaya pencegahan, dan melakukan upaya represif (3) Kendala Yang Dihadapi Polres Serdang Bedagai Dalam menaggulangi Kasus Anak Korban Perundungan Fisik yakni kendala dari pelaku, kendala dari balai pemasyarakatan, dan kendala dari orangtua. Saran dari tesis yakni kepada orang tua agar mengawasi anak – anaknya dalam pergaulan guna mengantisipasi anak untuk tidak ikut serta dalam melakukan kejahatan perudungan fisik. This thesis research is entitled Victimology Study of Children Victims of Physical Abuse (Study at the Serdang Bedagai Police Station). The formulation of the problem is (1) What is the form of legal protection for children who are victims of physical bullying? (2) What are the efforts of the Serdang Bedagai Police in dealing with cases of children who are victims of physical bullying? (3) What are the obstacles faced by the Serdang Bedagai Police in dealing with cases of child victims of physical bullying? This research aims to examine and analyze the forms of legal protection for children who are victims of physical bullying in terms of the victimological aspect. This research method uses normative juridical research methods. Data collection techniques include interviews and literature study. The results of the research show that (1) the form of legal protection for children who are victims of physical bullying is legal protection based on Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection. (2) Efforts by the Serdang Bedagai Police in dealing with cases of children who are victims of physical bullying, namely providing counseling, collaborating with child protection institutions, carrying out preventive efforts, and carrying out repressive efforts (3) Obstacles faced by the Serdang Bedagai Police in dealing with cases of children who are victims of bullying. Physical, namely obstacles from the perpetrator, obstacles from the correctional center, and obstacles from parents. The suggestion from the thesis is for parents to supervise their children socially in order to anticipate that children will not participate in committing crimes of physical bullying.
