Abstract: Fenomena di tengah-tengah masyarakat menunjukkan tindak pidana pencurian tidak hanya dilakukan oleh orang dewasa, namun juga oleh anak di bawah umur. Oleh karena itu penanganannya harus berbeda dengan penanganan orang dewasa salah satunya melalui penerapan sanksi pembinaan non penal. Permasalahan dalam penelitian ini adalah apa faktor penyebab anak melakukan tindak pidana pencurian pemberatan di wilayah hukum Polres Belawan dan bagaimana upaya kepolisian dalam kebijakan non penal pencurian pemberatan yang dilakukan oleh anak.Metode penelitian menggunakan yuridis normatif dengan sifat deskriptif. Analisis data secara kualitatif, yaitu menguraikan dan menginterpretasikan data dalam bentuk kalimat yang baik dan benar untuk memperoleh jawaban singkat yang dirumuskan secara deduktif.Hasil penelitian faktor penyebab anak melakukan tindak pidana pencurian pemberatan secara internal anak tidak mempunyai uang dan usia di bawah umur, secara eksternal status ekonomi tidak mampu, ada pembiaran terhadap anak, pendidikan rendah dan pergaulan bebas. Hambatan yang dihadapi ada kecenderungan orangtua melakukan pembiaran terhadap kejahatan anak dan upaya yang dilakukan melalui non penal yaitu mediasi dan kerja sama dengan kepala lingkungan, tokoh masyarakat, pihak kepolisian, pihak Babinsa dan pihak Balpas. Harapan ke depan anak tidak mengalami hukuman penjara tetapi dilakukan pembinaan oleh orangtua. Phenomena in society showed that theft crimes were not only committed by adults but also by underage children. Therefore, the handling process must differ from that of adults, one of which was the application of non-penal rehabilitation sanctions. The research aimed to identify the factors causing children to commit aggravated theft crimes in the jurisdiction of the Belawan Police and to analyze the police's efforts in implementing non-penal policies toward these children. The research used a normative juridical method with a descriptive nature. Data were analyzed qualitatively by explaining and interpreting the data in well-structured sentences to obtain conclusions deductively. The results showed that internal factors included lack of money and young age, while external factors included low economic status, neglect by parents, low education, and negative peer influence. The obstacles faced included parental neglect of their children's crimes. The nonpenal efforts carried out included mediation and collaboration with neighborhood heads, community leaders, police officers, village officials, and the child protection agency. The future expectation was that children would not be imprisoned but rehabilitated by their parents.
