Abstract: | Tujuan Penelitian ini adalah untuk menganalisis peranan Ankum (Atasan yang Berhak Menghukum) dan Papera (Perwira Penyerah Perkara) dalam proses penyelesaian perkara tindak pidana militer di wilayah yurisdiksi Pengadilan Militer Tinggi I Medan. Fokus penelitian ini adalah memahami bagaimana kewenangan dan tanggung jawab kedua pihak tersebut diimplementasikan dalam kerangka hukum militer yang berlaku, serta bagaimana pengaruhnya terhadap efektivitas penyelesaian perkara tindak pidana militer. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan undang-undang dan studi kasus. Data diperoleh melalui analisis dokumen hukum, wawancara dengan praktisi militer, serta studi terhadap putusan perkara yang telah diselesaikan di Pengadilan Militer Tinggi I Medan atau di Pengadilan Militer I-02 Medan Pembahasan dalam penelitian ini adalah menunjukkan bahwa peranan Ankum dalam tahap awal proses penyelesaian perkara sangat krusial, khususnya dalam menentukan apakah suatu kasus layak dilanjutkan ke tahap peradilan atau diselesaikan secara administratif. Di sisi lain, Papera berperan signifikan dalam memastikan kelengkapan berkas perkara dan memfasilitasi kelancaran proses hukum di pengadilan militer. Peran Ankum dan Papera dalam Undang-Undang No.31 Tahun 1997, meskipun peran keduanya telah diatur dengan jelas dalam Undang-Undang tersebut, terdapat beberapa kendala, seperti kurangnya pemahaman hukum oleh Ankum dan Papera, serta minimnya pelatihan terkait proses hukum militer, yang dapat menghambat efisiensi penyelesaian perkara. Berdasarkan pembahasan disimpulkan bahwa optimalisasi peranan Ankum dan Papera memerlukan peningkatan kapasitas melalui pelatihan hukum militer, serta penguatan mekanisme koordinasi antara keduanya untuk memastikan proses penyelesaian perkara berjalan sesuai prinsip keadilan dan efisiensi. Guna menunjang kecepatan penyelesaian proses perkara maka kewenangan Papera haruslah ditiadakan dan pelimpahan Perkara tidak memerlukan lagi Skeppera cukup dengan Surat Perintah dari Ankum sehingga penyelesaian proses perkara cepat, tepat dan sederhana seperti Pengadilan lainnya, sehingga asas peradilan harus dilakukan dengan cepat, sederhana dan biaya ringan serta bebas, jujur, dan tidak memihak harus diterapkan secara konsekwen dalam seluruh tingkat Peradilan Militer. The purpose of this research is to analyze the role of the Ankum (the Superior Authorized to Impose Punishment) and the Papera (the Officer Submitting the Case) in the process of resolving military criminal cases within the jurisdiction of the High Military Court I Medan. The focus of the study is to understand how the authority and responsibilities of both parties are implemented within the existing military legal framework, as well as how their roles influence the effectiveness of military criminal case resolution. The research method used is normative juridical, employing a statutory and case study approach. Data were obtained through legal document analysis, interviews with military practitioners, and the study of case decisions resolved by the High Military Court I Medan or Military Court I-02 Medan. This study discusses the pivotal role of the Ankum during the initial stage of case resolution, particularly in assessing whether a case warrants judicial proceedings or can be settled through administrative measures. Conversely, the Papera holds a significant function in ensuring the completeness of case documentation and in facilitating the efficient progression of legal proceedings within the military judiciary. Although the roles of the Ankum and Papera are clearly regulated in Law No. 31 of 1997, several obstacles remain, such as the limited legal understanding among some Ankums and Paperas, as well as the lack of adequate training on military legal procedures, which can hinder the efficiency of case resolution. Based on the analysis, it is concluded that optimizing the roles of the Ankum and Papera requires capacity-building through military legal training, as well as strengthening coordination mechanisms between the two to ensure that the case resolution process is conducted in accordance with the principles of justice and efficiency. To enhance the speed of the case resolution process, it is proposed that the authority of the Papera be abolished, and that the transfer of cases no longer requires a Skeppera (Case Submission Decree), but only a written order from the Ankum. This would allow the resolution of cases to be fast, accurate, and simple, in line with other judicial institutions. Therefore, the principles of justice—namely, expediency, simplicity, low cost, and a process that is free, honest, and impartial—must be applied consistently at all levels of the military judiciary. |
