Abstract: Tujuan penelitian ini adalah menganalisis penerapan hukum dan pembuktian mengenai pasal 112 dan 127 Undang-undang Nomor 35 tahun 2009 tentang narkotika dan untuk mengevaluasi serta menentukan perbedaan putusan hakim Pengadilan Negeri Binjai apakah telah memperoleh pembenaran menurut hukum terhadap pelaku penyalah guna narkotika. Adapun rumusan masalah dalam penelitian ini, yaitu: Pertama bagaimana kajian umum tindak pidana narkotika di Indonesia; Kedua bagaimana tindak pidana narkotika dalam Pasal 112 dan Pasal 127 Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika? dan Ketiga bagaimana analisis yuridis pertimbangan hakim terhadap penerapan hukum dan Pembuktian Pasal 112 dan Pasal 127 Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika dalam Putusan Nomor: 154/Pid.Sus/2023/PN.Bnj dan Putusan Nomor: 294/Pid.Sus/2023/PN.Bnj. Adapun metode penelitian yang digunakan yaitu penelitian yuridis normatif, dengan instrumen pengumpulan data studi kepustakaan dan wawancara sedangkan dianalisisnya menggunakan deskripstif kualitatif. Hasil penelitian menunjukan bahwa aturan hukum yang terkandung di dalam Pasal 112 dan Pasal 127 Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika dapat dikatakan bahwa kedua pasal tersebut masih belum memberikan suatu kepastian hukum. Penerapan Pasal 112 dan Pasal 127 Undang-Undang Nomor 35 Tahun 2009 memerlukan pendekatan yang hati-hati, agar tidak terjadi kriminalisasi terhadap pengguna yang seharusnya mendapatkan rehabilitasi. Pembuktian terhadap unsur "tanpa hak" dalam Pasal 112 dan "penyalahgunaan" dalam Pasal 127 harus didasarkan pada bukti kuat, objektivitas, dan prinsip keadilan. Pertimbangan hakim dalam penerapan Pasal 112 dan Pasal 127 UU No. 35 Tahun 2009 memerlukan pendekatan yuridis yang mendalam, dengan fokus pada asas keadilan, proporsionalitas, dan kepastian hukum. Hakim harus mampu membedakan antara pengguna dan pengedar, serta memanfaatkan asas keadilan restoratif untuk pengguna yang membutuhkan rehabilitasi. The purpose of this study is to analyze the application of law and evidence regarding articles 112 and 127 of Law Number 35 of 2009 concerning narcotics and to evaluate and determine the differences in the decisions of the Binjai District Court judges whether they have obtained legal justification for perpetrators of drug abuse. The formulation of the problem in this study is: First, how is the general study of narcotics crimes in Indonesia; Second, how are narcotics crimes in Article 112 and Article 127 of Law Number 35 of 2009 concerning Narcotics? and Third, how is the legal analysis of the judge's considerations regarding the application of law and Evidence of Article 112 and Article 127 of Law Number 35 of 2009 concerning Narcotics in Decision Number: 154 / Pid.Sus / 2023 / PN.Bnj and Decision Number: 294 / Pid.Sus / 2023 / PN.Bnj. The research method used is normative legal research, with data collection instruments of literature studies and interviews while the analysis uses qualitative descriptive. The results of the study indicate that the legal regulations contained in Article 112 and Article 127 of Law Number 35 of 2009 concerning Narcotics can be said that both articles still do not provide legal certainty. The application of Article 112 and Article 127 of Law Number 35 of 2009 requires a careful approach, so that there is no criminalization of users who should receive rehabilitation. Proof of the elements of "without rights" in Article 112 and "abuse" in Article 127 must be based on strong evidence, objectivity, and the principle of justice. The judge's considerations in the application of Article 112 and Article 127 of Law No. 35 of 2009 require an in-depth legal approach, with a focus on the principles of justice, proportionality, and legal certainty. Judges must be able to distinguish between users and dealers, and utilize the principles of restorative justice for users who need rehabilitation.
