Abstract: | Permasalahan dominan dalam penuntutan kasus narkotika adalah kendala yang dihadapi di lapangan, sebab penuntut umum tidak bisa melakukan penyidikan secara langsung.Tujuan penelitian ini untuk mengetahui proses penuntutan terhadap pengedar tindak pidana narkotika golongan I dan kendala dalam penuntutan.Metode penelitian menggunakan penelitian yuridis empiris. Jenis data primer dan data sekunder.Pengumpulan data dengan teknik studi dokumentasi dan wawancara.Analisis data secara deskriptif kualitatif.Hasil Penelitian bahwa proses penuntutan pidana terhadap pengedar tindak pidana narkotika golongan I dilakukan dengan adanya Surat Pelimpahan Perkara Nomor B-1203/L.2.37/Eoh.2/11/2023 tanggal 21 November 2023. Pihak terkait dalam proses penuntutan yaitu penyidik POLRI, Badan Narkotika Nasional, Majelis Hakim; Panitera; dan saksi. Proses penuntutan diawali saat Kejaksaan mendapat Surat Pemberitahuan Dimulainya Penyidikan (SPDP) sampai Berita Acara Pemeriksaan (BAP); Penyelidikan; Penyidikan; Praperuntutan; Penuntutan dan Eksekusi. Kendala dalam penuntutan yaitu tidak ada saksi dari pihak terdakwa dan barang bukti tidak mencapai 1 gram.Upaya untuk mengatasi hambatan dengan menambah saksi dari pihak sipil yang membantah pelaku adalah pemakai. Harapan ke depannya Jaksa terjun langsung pada saat penyidikan dan diberi kewenangan untuk melakukan tes urin pada pelaku di awal sebagai alternatif menentukan pasal pengedar. The dominant problem in prosecuting narcotics cases is the obstacles faced in the field, because the public prosecutor cannot conduct investigations directly. The purpose of this study is to determine the prosecution process against dealers of class I narcotics crimes and obstacles in prosecution. The research method uses empirical juridical research. Types of primary data and secondary data. Data collection with documentation and interview study techniques. Data analysis is descriptive qualitative. The results of the study are that the criminal prosecution process against dealers of class I narcotics crimes is carried out with the existence of a Case Transfer Letter Number B-1203 / L.2.37 / Eoh.2 / 11/2023 dated November 21, 2023. The parties involved in the prosecution process are POLRI investigators, the National Narcotics Agency, the Panel of Judges; the Registrar; and witnesses. The prosecution process begins when the Prosecutor's Office receives a Letter of Notification of Commencement of Investigation (SPDP) to the Examination Report (BAP); Investigation; Investigation; Pre-prosecution; Prosecution and Execution. Obstacles to the prosecution include the lack of witnesses from the defendant's side and the evidence weighing less than 1 gram. Efforts to overcome these obstacles include the addition of civilian witnesses who deny the perpetrator is a user. It is hoped that in the future, prosecutors will be directly involved in the investigation and be authorized to conduct urine tests on perpetrators early on as an alternative to determining the distribution charge. |
