Abstract: Penerapan Pencegahan Pelanggaran HKI melalui Rekordasi merek, dalam hal ini Direktorat Jenderal Bea dan Cukai membuat perlindungan hukum berdasarkan sistem first to file principle atau sistem perekaman (rekordasi) atau yang biasa dikenal dengan istilah CEISA yang diberikan kepada pemegang hak merek terdaftar dan memberikan landasan hukum secara ex officio untuk melakukan (penegahan, penangguhan sementara, pemeriksaan fisik) barang impor atas dasar perintah pengadilan. Bahwa hak-hak pemilik atau pemegang hak merek tersebut hanya dapat dilakukan atas inisiatifnya sendiri, tanpa ada inisiatif tindakan Pejabat Bea Cukai secara ex officio dan tindakan yudisial tidak dapat dilaksanakan sesuai dengan aturan yang terdapat di dalam PP No.20 Tahun 2017 jo. PMK No. 40 Tahun 2018. Implementing IPR Infringement Prevention through Trademark Registration, in this case, the Directorate General of Customs and Excise provides legal protection based on the first-to-file principle or recording system (commonly known as CEISA), which is granted to registered trademark rights holders and provides an ex-officio legal basis for (prevention, temporary suspension, physical inspection) of imported goods based on a court order. The rights of trademark owners or rights holders can only be exercised on their own initiative; without the initiative of a Customs Official, ex-officio action and judicial action cannot be implemented, in accordance with the provisions stipulated in Government Regulation No. 20 of 2017 in conjunction with Minister of Finance Regulation No. 40 of 2018.
