Abstract: Tindak Pidana Kekerasan Seksual yakni tindak kekerasan yang dilakukan untuk memperoleh suatu tindakan yang diarahkan pada seksualitas seseorang. Permasalahan yang diteliti pada penelitian yaitu pengaturan hukum tentang tindak pidana kekerasan seksual di Indonesia, serta implementasi perlindungan hukum terhadap penyandang disabilitas yang menjadi korban Tindak Pidana Kekerasan Seksual berdasarkan putusan Nomor 1245/Pid.b/2023/PN Mdn. Metode penelitian menggunakan penelitian yuridis normatif dengan sumber bahan hukum yang didapatkan berdasarkan pada data primer berupa Undang-Undang, data sekunder berupa buku dan jurnal yang relevan pada pembahasan penelitian, serta data tersier yakni berupa kamus - kamus, ensiklopedia maupun suatu artikel pendukung dan teknik pengumpulan data dilakukan dengan dua cara yaitu melakukan penelitian kepustakaan (library research) dan melakukan penelitian lapangan (field research) yang dianalisis secara kualitatif. Hasil penelitian yaitu pengaturan hukum mengenai kekerasan seksual terhadap penyandang disabilitas diatur dalam Undang-Undang Nomor 12 Tahun 2022 Tentang Tindak Pidana Kekerasan Seksual serta bagaimana implementasi perlindungan hukumnya terhadap korban tindak pidana kekerasan seksual. Implementasi perlindungan hukum terhadap penyandang disabilitas melalui bentuk penegakan hukum represif. Dimana berdasarkan pada Putusan Nomor 1245/Pid.b/2023/PN Mdn pelaku hanya dijatuhi Hukuman 7 (tujuh) tahun 5 (lima) bulan penjara. Putusan ini belum mencerminkan perlindungan hukum terhadap korban dikarenakan amanat pada Pasal 16 ayat (1) Undang-Undang nomor 12 Tahun 2022 tidak dijatuhkan oleh hakim kepada pelaku tindak pidana kekerasan seksual. Sexual violence crimes were acts of violence committed to obtain actions directed at a person's sexuality. The issues studied in this research were the legal regulations on sexual violence crimes in Indonesia and the implementation of legal protection for persons with disabilities who became victims of sexual violence crimes based on Decision Number 1245/Pid.b/2023/PN Mdn. The research method used normative juridical research, with sources of legal materials obtained based on primary data in the form of laws, secondary data in the form of relevant books and journals, and tertiary data in the form of dictionaries, encyclopedias, or supporting articles. The data collection techniques were conducted in two ways: library research and field research, analyzed qualitatively. The research results were that the legal regulation regarding sexual violence against persons with disabilities was stipulated in Law Number 12 of 2022 on Sexual Violence Crimes and how the implementation of their legal protection against victims of sexual violence crimes. The implementation of legal protection for persons with disabilities was through a form of repressive law enforcement. Based on Decision Number 1245/Pid.b/2023/PN Mdn, the perpetrator was only sentenced to 7 (seven) years and 5 (five) months in prison. This decision did not yet reflect the legal protection for victims because the mandate in Article 16 paragraph (1) of Law Number 12 of 2022 was not imposed by the judge on the perpetrator of the sexual violence crime.
