Kajian Hukum terhadap Peralihan Hak Atas Tanah Warisan yang Batal Demi Hukum karena Melanggar Hak Ahli Waris Lainnya

Abstract

Perlindungan hukum terhadap ahli waris dalam pelaksanaan peralihan hak atas tanah warisan adalah berdasarkan ketentuan Pasal 852 ayat (1) dan ayat (2) KUHPerdata dan Pasal 913 KUHPerdata, sehingga jika harta warisan tersebut dijual oleh seseorang yang tidak memiliki hak untuk melakukannya tidak dapat dibenarkan menurut hukum, karena hak kepemilikan atas tanah warisan tetap dimiliki oleh para ahli waris. Oleh karena itu, berdasarkan ketentuan Pasal 1471 KUHPerdata, transaksi jual beli barang yang sebenarnya dimiliki oleh orang lain dianggap tidak sah, sehingga peralihan hak atas tanah warisan yang melanggar hak ahli waris lainnya dianggap tidak sah atau batal demi hukum. Legal protection for heirs in the transfer of rights to inherited land is based on the provisions of Article 852 paragraphs (1) and (2) of the Civil Code and Article 913 of the Civil Code. Therefore, if the inherited property is sold by someone who does not have the right to do so, it cannot be legally justified, because ownership of the inherited land remains with the heirs. Therefore, based on the provisions of Article 1471 of the Civil Code, the sale and purchase of goods actually owned by another person is considered invalid, so the transfer of rights to inherited land that violates the rights of other heirs is considered invalid or null and void.
