Abstract: | Cohabitation merupakan hal yang dilarang dan tidak sesuai dengan aturan hukum dan agama sehingga kasus tersebut menghadirkan tantangan hukum, terutama dalam pembagian aset saat hubungan berakhir. Tanpa pernikahan sah, pasangan tidak memiliki perlindungan hukum atas properti bersama, sering memicu sengketa. Kurangnya bukti formal menyulitkan proses hukum, sementara mediasi menjadi alternatif. Kasus seperti hakim dalam putusan Pengadilan Negeri Nomor 280/Pdt.G/2023/PNMdn menegaskan perlunya regulasi yang lebih jelas. Permasalahan yang diangkat dalam skripsi ini adalah mengenai penyelesaian sengketa kepemilikan sertifikat rumah oleh orang yang hidup bersama tanpa ikatan perkawinan, akibat hukum kepemilikan sertifikat rumah oleh orang yang hidup bersama tanpa ikatan perkawinan dan pertimbangan hakim dalam putusan Pengadilan Negeri Nomor 280/Pdt.G/2023/PNMdn. Metode yang digunakan dalam pembahasan permasalah tersebut adalah penelitian hukum yuridis normatif dengan mengkaji dan menganalisis data sekunder berupa bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Penyelesaian kepemilikan sertifikat rumah oleh pasangan yang hidup bersama tanpa ikatan perkawinan menyoroti kurangnya regulasi tentang hak harta bersama bagi pasangan tidak menikah hal ini juga akibat karena kasus pasangan hidup bersama tanpa pernikahan sangat dilarang. Akibat hukum dari kasus ini menunjukkan bahwa hak atas properti bersama tetap dapat dipertahankan meskipun tidak diatur dalam hukum Indonesia. Pengadilan membagi properti berdasarkan kontribusi masing-masing pihak dan memberikan kompensasi atas kerugian materiil dan immateriil. Pertimbangan hakim dalam Putusan Nomor 280/Pdt.G/2023/PN Mdn, Hakim menegaskan bahwa pasangan tetap memiliki hak atas properti bersama walau hidup bersama tanpa pernikahan dilarang. Sehingga rumah dibagi dua, Tergugat diwajibkan membayar ganti rugi, serta sertifikat dibagi dan uang paksa dikenakan jika keputusan tidak dipatuhi. Sehingga kasus hidup bersama tanpa pernikahan merupkan hal tidak dapat dilakukan karena melanggar hukum dan dapat merugikan bagi kedua belah pihak. Cohabitation is prohibited and violates legal and religious rules, thus presenting legal challenges, particularly in the division of assets upon the end of a relationship. Without a legal marriage, couples lack legal protection over joint property, often leading to disputes. The lack of formal evidence complicates the legal process, while mediation is an alternative. Cases such as the judge's ruling in District Court Number 280/Pdt.G/2023/PNMdn emphasize the need for clearer regulations. The issues raised in this thesis concern the resolution of disputes over house certificate ownership by unmarried cohabitants, the legal consequences of house certificate ownership by unmarried cohabitants, and the judge's considerations in District Court Decision Number 280/Pdt.G/2023/PNMdn. The method used in discussing these issues is normative juridical legal research, which examines and analyzes secondary data in the form of primary, secondary, and tertiary legal materials. The settlement of house certificate ownership by couples living together without marriage ties highlights the lack of regulation regarding joint property rights for unmarried couples. This is also due to the fact that cases of couples living together without marriage are strictly prohibited. The legal consequences of this case show that the right to joint property can still be maintained even though it is not regulated by Indonesian law. The court divided the property based on each party's contribution and awarded compensation for material and immaterial losses. The judge's consideration in Decision Number 280/Pdt.G/2023/PN Mdn, the Judge emphasized that couples still have rights to joint property even though living together without marriage is prohibited. Therefore, the house was divided in two, the Defendant was required to pay compensation, the certificate was divided, and forced money was imposed if the decision was not complied with. Therefore, cases of living together without marriage are impossible because they violate the law and can be detrimental to both parties. |
