Abstract: | Penelitian ini bertujuan untuk menganalisis penerapan perlindungan konsumen terhadap produk halal pada makanan kemasan siap saji oleh Dinas Perindustrian, Perdagangan, Energi, dan Sumber Daya Mineral Provinsi Sumatera Utara. Fokus penelitian mencakup aspek perlindungan konsumen, faktor penghambat, serta peran dinas terkait dalam memberikan perlindungan hukum. Metode yang digunakan adalah pendekatan hukum yuridis normatif dengan analisis kualitatif melalui wawancara. Hasil penelitian menunjukkan bahwa aspek sertifikat halal dalam memberikan jaminan dan perlindungan bagi konsumen Muslim serta mendorong pelaku industri pangan untuk memperoleh sertifikasi halal. Adapun faktor-faktor dalam proses sertifikasi menghadapi kendala seperti rendahnya kesadaran pelaku Industri Kecil dan Menengah (IKM), keterbatasan anggaran,belum adanya Peraturan Daerah (Perda) yang mengatur perlindungan konsumen terhadap produk halal, serta biaya dan standar sertifikasi yang ketat. Dinas Perdagangan Kota Medan menyatakan bahwa peran Dinas Perindustrian, Perdagangan, Energi, dan Sumber Daya Mineral Provinsi Sumatera Utara serta UPT Perlindungan Konsumen dan Badan Penyelesaian Sengketa Konsumen Kota Medan dalam mengawasi dan memberikan perlindungan terhadap produk halal pada makanan kemasan siap saji tetap berjalan, meskipun belum terdapat regulasi daerah khusus terkait produk halal. Dinas ini tetap berpedoman pada regulasi nasional dan bekerja sama dengan berbagai pihak, seperti BPJPH, Sucofindo, LPPOM MUI, dan BPOM, untuk memastikan kepatuhan produsen terhadap standar halal. This study aims to analyze the implementation of consumer protection for halal products in ready-to-eat packaged foods by the Department of Industry, Trade, Energy, and Mineral Resources of North Sumatra Province. The focus of the study includes aspects of consumer protection, inhibiting factors, and the role of related agencies in providing legal protection. The method used is a normative legal approach with qualitative analysis through interviews. The results of the study indicate that the halal certificate aspect provides guarantees and protection for Muslim consumers and encourages food industry players to obtain halal certification. The factors in the certification process face obstacles such as low awareness of Small and Medium Industry (IKM) players, limited budget, the absence of Regional Regulations (Perda) governing consumer protection for halal products, and strict certification costs and standards. The Medan City Trade Office stated that the role of the Department of Industry, Trade, Energy, and Mineral Resources of North Sumatra Province and the Consumer Protection UPT and the Medan City Consumer Dispute Resolution Agency in supervising and providing protection for halal products in ready-to-eat packaged foods continues, even though there are no specific regional regulations related to halal products. This service continues to adhere to national regulations and collaborates with various parties, such as BPJPH, Sucofindo, LPPOM MUI, and BPOM, to ensure producer compliance with halal standards. |
