Abstract: | Anak-anak merupakan bagian dari generasi muda yang sedang tumbuh dan berkembang, baik jasmani maupun rohani. Pencurian yang dilakukan oleh anak-anak didefinisikan dalam Pasal 362 KUHP sebagai "oogmerk", yang memiliki arti yang sama dengan "opzet", yang biasanya diterjemahkan sebagai "sengaja". "Dengan sengaja" atau "dengan maksud" berarti disengaja dengan kepastian/keharusan, yaitu pengetahuan bahwa ada hubungan antara pikiran atau akal terdakwa dengan kejahatan yang dilakukan. Children are part of the younger generation who are growing and developing, both physically and spiritually. Theft committed by children is defined in Article 362 of the Criminal Code as "oogmerk," which has the same meaning as "opzet," which is usually translated as "intentionally." With intent," or "with intention," is intentional with certainty/necessity, which is knowledge that there is a connection between the defendant's mind or intellect and the crime. |
