dc.description.abstractPenyelundupan manusia merupakan salah satu bentuk kejahatan transnasional yang sering terjadi dalam konteks penempatan pekerja migran Indonesia. Kejahatan ini tidak hanya melanggar hukum nasional tetapi juga berisiko tinggi terhadap hak asasi manusia, terutama bagi pekerja migran yang direkrut secara ilegal. Studi ini berfokus pada kajian hukum atas tindak pidana bagi pelaku penyelundupan manusia dalam penempatan pekerja migran Indonesia, dengan studi kasus Putusan Pengadilan Negeri Medan Nomor 2006/Pid.B/2023/PN Mdn. Penelitian ini bertujuan untuk mengetahui pengaturan hukum terkait tindak pidana penyelundupan manusia di Indonesia, serta menganalisis pertimbangan hakim dalam menjatuhkan putusan terhadap pelaku. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan perundang-undangan serta analisis terhadap putusan pengadilan yang relevan. Hasil penelitian menunjukkan bahwa regulasi terkait penyelundupan manusia telah diatur dalam berbagai peraturan perundang-undangan, termasuk KUHP, Undang-Undang Keimigrasian, serta Undang-Undang Perlindungan Pekerja Migran Indonesia. Namun, implementasi dan penegakan hukumnya masih menghadapi tantangan, terutama dalam hal pengawasan dan penerapan sanksi yang lebih efektif. Kesimpulannya, Diperlukan penguatan sistem penegakan hukum serta peningkatan kesadaran masyarakat mengenai risiko penyelundupan manusia agar kejadian serupa dapat diminimalisir di masa mendatang. Human smuggling is one of the forms of transnational crimes that frequently occur in the context of the placement of Indonesian migrant workers. This crime not only violates national law but also poses a high risk to human rights, especially for migrant workers who are illegally recruited. This research focuses on the legal review of the criminal act of human smuggling in the placement of Indonesian migrant workers, using the case study of Medan District Court Decision Number 2006/Pid.B/2023/PN Mdn. This research aims to find out the legal regulations related to the criminal act of human smuggling in Indonesia, as well as analyze the judge’s considerations in issuing decisions against the perpetrators. The research method used was normative juridical, with a statutory approach and analysis of relevant court decisions. The results of the research showed that regulations related to human smuggling had been stipulated in various laws and regulations, including the Criminal Code, the Immigration Law, and the Law on the Protection of Indonesian Migrant Workers. However, its implementation and law enforcement still faced challenges, especially in terms of supervision and the application of more effective sanctions. In conclusion, it is necessary to strengthen the law enforcement system and increase public awareness regarding the risks of human smuggling so that similar incidents can be minimized in the future.en_US
