Abstract: Penyelesaian sengketa kredit bank terhadap debitur yang meninggal dunia merupakan permasalahan hukum yang sering muncul dalam praktik perbankan. Permasalahan ini timbul karena adanya kewajiban pelunasan kredit yang belum selesai saat debitur meninggal dunia yang mana sidebitur tidak diasuransikan oleh kreditur sehingga timbul risiko hutang turun temurun kepada ahli waris dan beban finansial dari sisa hutang sidebitur ketika sidebitur meninggal dunia pada masa kredit belum selesai. Penelitian ini bertujuan untuk menganalisis bagaimana aturan hukum mengenai asuransi apabila debitur meninggal dunia, bagaimana mekanisme perjanjian kredit dan mekanisme pengklaiman asuransi apabila debitur meninggal dunia. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual, serta didukung oleh data sekunder berupa undang-undang nomor 40 tahun 2014, POJK nomor 20 tahun 2023, KUHDagang, dan KUHPerdata dan literatur terkait. Hasil penelitian menunjukkan bahwa ketika debitur meninggal dunia yang mana debiturnya tidak diasuransikan ahli waris punya hak untuk memilih apakah menerima atau menolak hutang sidebitur tersebut. Penyelesaian sengketa dapat ditempuh melalui jalur nonlitigasi dimana para pihak dimediasi oleh seorang mediator lalu membuat Berita Acara dan didaftarkan untuk memperoleh putusan inkrah berdasarkan undangundang ADR Nomor 30 Tahun 1999. The settlement of bank credit disputes involving deceased debtors is a recurring legal issue in banking practice. This issue arises due to the existence of outstanding loan obligations at the time of the debtor’s death, where the debtor was not covered by insurance arranged by the creditor. This situation creates a risk of inherited debt for the heirs and imposes a financial burden due to the remaining loan obligations that persist beyond the debtor’s death, particularly when the credit term has not yet expired. This study aims to analyze the legal framework concerning insurance coverage in the event of a debtor's death, the mechanism of credit agreements, and the process of claiming insurance in such situations. The research employs a normative juridical method, utilizing statutory and conceptual approaches, supported by secondary data including Law No. 40 of 2014, Financial Services Authority Regulation (POJK) No. 20 of 2023, the Indonesian Commercial Code (KUHD), the Indonesian Civil Code (KUHPerdata) and relevant literature.The findings indicate that in cases where a deceased debtor was not insured, the heirs have the right to choose whether to accept or reject the deceased’s outstanding debts. Dispute resolution may be pursued through non-litigation channels, whereby the parties engage in mediation facilitated by a mediator, followed by the drafting of an official report which is then registered in order to obtain a legally binding decision, in accordance with the provisions of Law No. 30 of 1999 on Alternative Dispute Resolution.
