Penerapan Sanksi Pidana Terhadap Pelaku Turut serta dalam Tindak Pidana Memperniagakan Satwa yang dilindungi (Studi Putusan Pengadilan Negeri Medan Nomor 2506/Pid.B/LH/2023/PN.Mdn)

Abstract

Tindak pidana memperniagakan satwa semakin marak terjadi seiring dengan meningkatnya pasar gelap dan lemahnya pengawasan. Padahal Undang- Undang Nomor 5 Tahun 1990 tentang Konservasi Sumber Daya Alam Hayati dan Ekosistemnya Jo Undang-Undang Nomor 32 Tahun 2024 tentang Perubahan Atas Undang Nomor 5 Tahun 1990 secara tegas melarang perniagaan satwa liar namun praktik pelanggaran masih banyak termasuk pelaku yang turut serta. Penelitian ini penting untuk menjawab beberapa masalah, yaitu bagaimana pengaturan hukum terhadap pelaku turut serta dalam tindak pidana ini, bagaimana dampak yang ditimbulkan, bagaimana penerapan sanksi pidana terhadap pelaku turut serta. Metode penelitian yang digunakan adalah yuridis normatif dengan sifat deskriptif analitis. Hasil penelitian menunjukkan bahwa pengaturan hukum telah tersedia secara tegas dan diperkuat oleh pembaruan undang-undang. Dampak yang ditimbulkan akibat tindak pidana ini sangat serius seperti rusaknya ekosistem, kerugian negara, dan hilangnya mata pencaharian masyarakat lokal. Penerapan sanksi terhadap pelaku turut serta sesuai dengan ketentuan dengan Pasal 40 ayat (2) Jo Pasal 21 ayat (2) Undang-Undang Nomor 5 Tahun 1990 termasuk dalam keterlibatan terdakwa yang dikenakan Pasal 55 KUHP dikategorikan sebagai turut serta bersama-sama dengan pelaku utama. Oleh karena itu diperlukan penegakan hukum yang lebih tegas serta penguatan pengawasan secara ketat agar menjamin perlindungan satwa secara berkelanjutan. The crime of trading in animals is increasingly rampant along with the increasing black market and weak supervision. In fact, Law Number 5 of 1990 concerning Conservation of Natural Resources and Ecosystems in conjunction with Law Number 32 of 2024 concerning Amendments to Law Number 5 of 1990 expressly prohibits the trade in wild animals, but there are still many violations, including perpetrators who participate. This research is important to answer several problems, namely how the legal regulations for perpetrators involved in this crime, what impacts are caused, how to apply criminal sanctions to perpetrators involved. The research method used is normative juridical with a descriptive analytical nature. The results of the study indicate that legal regulations have been explicitly available and strengthened by the renewal of the law. The impacts caused by this crime are very serious, such as damage to the ecosystem, state losses, and loss of livelihoods for local communities. The application of sanctions to perpetrators involved in accordance with the provisions of Article 40 paragraph (2) Jo Article 21 paragraph (2) of Law Number 5 of 1990 including the involvement of the defendant who is subject to Article 55 of the Criminal Code is categorized as participating together with the main perpetrator. However, the judge has not been able to apply the maximum sentence according to the provisions of the law. Therefore, stricter law enforcement and strengthened supervision are necessary to ensure the sustainable protection of wildlife.
