| Abstract: | Penelitian ini bertujuan untuk mengkaji tanggung jawab hukum PT Jasa Raharja terhadap klaim asuransi kecelakaan lalu lintas di Sumatera Utara, Adapun rumusan masalah yaitu Pertama, Bagaimana pengaturan hukum terhadap klaim asuransi kecelakaan lalu lintas pada PT Jasa Raharja Cabang Sumatera Utara. Kedua, Bagaimana tanggung jawab hukum terhadap klaim asuransi kecelakaan lalu lintas pada PT Jasa Raharja Cabang Sumatera Utara. Ketiga, Bagaimana kendala pelaksanaan tanggung jawab PT Jasa Raharja Cabang Sumatera Utara terhadap korban kecelakaan lalu lintas. Metode yang digunakan adalah yuridis empiris dengan pendekatan deskriptif analisis dengan teknik pengumpulan data melalui observasi, wawancara, dan studi dokumentasi. Hasil penelitian menunjukkan bahwa Pertama, PT Jasa Raharja Cabang Sumatera Utara menjalankan kewajiban hukumnya didasarkan pada sejumlah pengaturan hukum, termasuk Undang-Undang No. 33 Tahun 1964 dan Undang-Undang 34 Tahun 1964, yang menjadi landasan utama pendiriannya. Selain itu, Peraturan Pemerintah Nomor 37 Tahun 2017 Tentang Keselamatan Lalu Lintas dan Angkutan Jalan, Dan Undang-Undang No. 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan(LLAJ) mewajibkan setiap kendaraan bermotor untuk memiliki pertanggungan melalui Jasa Raharja. Kedua,Pelaksanaan tanggung jawab PT Jasa Raharja Kantor Cabang Sumatera Utara terhadap korban dalam kecelakaan lalu lintas telah dilaksanakan sesuai peraturan perundang-undangan dan peraturan menteri keuangan dengan prinsip pelayanan yang cepat, tepat, dan transparan Namun, dalam pelaksanaannya ditemukan hambatan seperti syarat dan waktu pengurusan pengajuan klaim asuransi kecelakaan lalu lintas. Ketiga, Kendala pelaksanaan tanggung jawab PT Jasa Raharja Cabang Sumatera Utara terhadap korban dalam kecelaakan lalu lintas menghadapi kendala mencakup kurangnya penyederhanaan prosedur administrasi dan pemanfaatan teknologi digital guna mempercepat proses pelayan b b an klaim serta keterbatasan SDM, sehingga dalam proses mengklaim santunan sering kali ditolak. Penelitian ini menyimpulkan bahwa meskipun PT Jasa Raharja telah menjalankan tanggung jawab hukumnya, diperlukan peningkatan sosialisasi kepada masyarakat dan koordinasi yang lebih baik dengan instansi terkait. to examine the legal responsibility of PT Jasa Raharja for traffic accident insurance claims in North Sumatra, The formulation of the problem is First, how is the legal arrangement for traffic accident insurance claims at PT Jasa Raharja North Sumatra Branch. Second, what is the legal responsibility for traffic accident insurance claims at PT Jasa Raharja North Sumatra Branch. Third, what are the obstacles to the implementation of the responsibilities of PT Jasa Raharja North Sumatra Branch for traffic accident victims. The method used is empirical juridical with a descriptive approach to analysis with data collection techniques through observation, interviews, and documentation studies. The results of the study show that first, PT Jasa Raharja North Sumatra Branch carries out its legal obligations based on a number of legal regulations, including Law No. 33 of 1964 and Law 34 of 1964, which are the main foundation of its establishment. And, Government Regulation No. 37 of 2017 concerning Traffic Safety and Road Transportation while Law No. 22 of 2009 concerning Road Traffic and Transportation (LLAJ) requires every motor vehicle to have coverage through Jasa Raharja. Second, the implementation of PT Jasa Raharja's responsibilities of the North Sumatra Branch Office to victims in traffic accidents has been carried out in accordance with laws and regulations and regulations of the minister of finance with the principle of fast, precise, and transparent service. However, in its implementation, obstacles were found such as the terms and time for processing the submission of traffic accident insurance claims. Third, obstacles to the implementation of PT Jasa Raharja North Sumatra Branch's responsibilities to victims in traffic accidents face obstacles including the lack of simplification of administrative procedures and the use of digital technology to speed up the claim service process and limited human resources, so that in the process of claiming compensation are often rejected.
