Abstract: Perjanjian kerja antara pekerja dan perusahaan, sering kali terjadi praktik penahanan ijazah sebagai bentuk jaminan agar pekerja memenuhi kontrak kerja tertentu. Praktik ini menimbulkan permasalahan hukum, terutama ketika terjadi pemutusan hubungan kerja secara sepihak namun perusahaan tetap menahan ijazah pekerja. Penelitian ini bertujuan untuk mengetahui peran Dinas Ketenagakerjaan Provinsi Sumatera Utara dalam menyelesaikan sengketa penahanan ijazah dalam hubungan kerja berdasarkan Perjanjian Kerja Waktu Tertentu (PKWT), dan mengetahui hak dan kewajiban hukum para pihak dalam konteks penyelesaian sengketa ketenagakerjaan serta penyelesaian berdasarkan Surat Edaran Nomor M/5/HK.04.00/V/2025 tentang Larangan Penahanan Ijazah dan/atau Dokumen Pribadi Milik Pekerja/Buruh Oleh Pemberi Kerja. Penelitian ini menggunakan metode yuridis normatif, dengan pendekatan deskriptif kualitatif. Data dikumpulkan melalui studi kepustakaan dan wawancara dengan pihak Dinas Ketenagakerjaan. Hasil penelitian menunjukkan bahwa penahanan ijazah tanpa dasar hukum yang jelas dapat dikategorikan sebagai perbuatan melawan hukum dan bertentangan dengan asas perlindungan pekerja sebagaimana diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan peraturan perundang-undangan lainnya. Selain itu, Dinas Ketenagakerjaan memiliki peran penting dalam memfasilitasi penyelesaian melalui jalur mediasi serta memberikan perlindungan terhadap hak-hak pekerja. Penelitian ini menegaskan pentingnya pembaruan kebijakan dan penegakan hukum dalam menanggapi praktik penahanan ijazah, agar tidak merugikan pekerja dan tetap menjaga keseimbangan hubungan industrial. In employment agreements between workers and companies, there is often a practice of withholding diplomas as a form of guarantee for workers to fulfill certain employment contracts. This practice raises legal issues, especially when there is a unilateral termination of employment but the company still withholds the worker's diploma. This study aims to determine the role of the North Sumatra Provincial Manpower Office in resolving disputes over diploma retention in employment relationships based on Fixed-Term Employment Agreements (PKWT), and to determine the legal rights and obligations of the parties in the context of resolving employment disputes and settlements based on Circular Letter Number M/5/HK.04.00/V/2025 concerning the Prohibition of Retention of Diplomas and/or Personal Documents of Workers/Laborers by Employers. This study uses a normative juridical method, with a qualitative descriptive approach. Data were collected through literature studies and interviews with the Manpower Office. The results of the study indicate that the withholding of diplomas without a clear legal basis can be categorized as an unlawful act and is contrary to the principle of worker protection as stipulated in Law Number 13 of 2003 concerning Manpower and other laws and regulations. Furthermore, the Manpower Office has a crucial role in facilitating settlements through mediation and protecting workers' rights. This study emphasizes the importance of policy reform and law enforcement in responding to the practice of withholding diplomas, so as not to harm workers and to maintain a balance in industrial relations.
