| dc.description.abstract | Tanah memiliki peran strategis dalam kehidupan masyarakat, baik sebagai sumber ekonomi maupun hak sosial. Dalam konteks hukum agraria Indonesia, Undang-Undang Pokok Agraria No. 5 Tahun 1960 menetapkan bahwa negara berwenang mengatur dan menguasai tanah untuk kemakmuran rakyat. Namun, kenyataan menunjukkan banyak masyarakat menguasai tanah negara tanpa legalitas yang sah, seperti pada kasus tanah garapan. Tanah garapan merupakan lahan yang dikelola tanpa hak resmi dan menimbulkan ketidakpastian hukum serta konflik agraria. Masalah dalam penelitian ini difokuskan pada bagaimana status hukum tanah garapan menurut Undang Undang di Indonesia, apa faktor-faktor terjadinya penguasaan tanah garapan diatas tanah negara di Kabupaten Deli Serdang, dan bagaimana hak kepemilikan terhadap penguasaan tanah garapan di Kabupaten Deli Serdang. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan analisis data secara kualitatif. Status tanah garapan belum diatur secara spesifik dalam UUPA maupun peraturan lainnya, namun demikian dasar hukum yang dijadikan acuan oleh para penggarap berupa Surat Keterangan Camat (SKT) yang diterbitkan oleh camat berfungsi sebagai bukti penguasaan atas sidang tanah yang digarap serta PP No. 24 Tahun 1997 membuka peluang pendaftaran hak atas tanah garapan melalui prosedur hukum yang sah. Faktor penguasaan tanah garapan meliputi ketimpangan kepemilikan, minimnya pekerjaan di luar sektor pertanian, dan migrasi penduduk. Agar penggarap memperoleh kepastian hukum, penguasaan tanah harus dibuktikan secara terus-menerus, fisik dan yuridis sesuai, dengan itikad baik, maka mereka dapat peluang untuk memperoleh hak atas tanah tersebut, dengan syarat tanah tersebut merupakan tanah negara yang belum dilekati hak oleh pihak lain. Land has a stategic role in people’s lives, both as a source of economic and social rights. In the context of indonesian agrarian law, Basic Agraria law No. 5 of 1960 stipulates that the state has the authority to regulate and control land for the prosperity of the people. However, reality shows that many people control state land without legal legality, such as in the case of cultivated land. Cultivated land is land that is managed without official rights and creates legal uncertainty and agrarian conflicts. The problem in this research is focused on what is the legal status of cultivated land according to indonesian law, what are the factors of tenure of cutivated land on state land, and what are the ownership rights to tenure of cultivated land. The research method used is normative juridical research with qualitative data analysis. The status of cultivated land is not specifically regulated in the UUPA or other regulations, but the legal basis used by cultivators is the District Head's Certificate (SKT) issued by the district head, which serves as proof of control over the cultivated land and Government Regulation No. 24 of 1997 opens up to possibility of registering rights to cultivated land through legal procedures. Factors in tenure of cultivated land include inequality of ownership, lack of work outside the agricultural sector, and population migration. In order for cultivators to obtain legal certainty, land tenure must be proven continuously, physically and juridically appropriate, in good faith, then they can have the opportunity to obtain rights to the land, provided that the land is state land that has not been attached to rights by other parties. | en_US |
