Abstract: Pemutusan hubungan kerja secara sepihak akibat penerimaan gratifikasi tanpa izin tertulis dari perusahaan merupakan fenomena yang menimbulkan permasalahan hukum dalam hubungan industrial. Kasus dalam Putusan No.251/Pdt.Sus- PHI/2023/PN Mdn menunjukkan bagaimana pekerja yang menerima gratifikasi dapat dijadikan dasar pemutusan hubungan kerja oleh perusahaan. Penelitian ini bertujuan untuk menganalisis kedudukan para pihak dalam sengketa PHK, pertimbangan hakim dalam memutus perkara, serta akibat hukum dari pemutusan hubungan kerja tersebut. Penelitian ini menggunakan metode yuridis normatif dengan studi kasus terhadap putusan pengadilan dan analisis terhadap peraturan ketenagakerjaan yang berlaku, termasuk Undang-Undang Nomor 13 Tahun 2003, Undang-Undang Cipta Kerja, dan PP No. 35 Tahun 2021. Hasil penelitian menunjukkan bahwa tindakan pekerja yang menerima gratifikasi tanpa izin pimpinan perusahaan dikualifikasikan sebagai pelanggaran serius sehingga PHK secara sepihak dianggap sah secara hukum apabila memenuhi prosedur formal. Hakim mempertimbangkan pelanggaran etika, prinsip kejujuran, dan potensi kerugian perusahaan. Penelitian merekomendasikan agar perusahaan memperjelas kebijakan anti-gratifikasi serta meningkatkan edukasi etika bisnis kepada pekerja guna mencegah terulangnya kasus serupa. Hakim dalam perkara ini mempertimbangkan aspek pelanggaran etika, kepatuhan terhadap aturan internal perusahaan, dan perlindungan terhadap integritas perusahaan. Penegakan hukum yang adil dan tegas diperlukan demi melindungi hak perusahaan tanpa mengabaikan perlindungan pekerja. Unilateral termination of employment due to the acceptance of gratuities without written permission from the company is a phenomenon that raises legal issues in industrial relations. The case in Decision No. 251/Pdt.Sus-PHI/2023/PN Mdn shows how workers who receive gratuities can be used as grounds for termination of employment by a company. This study aims to analyze the positions of the parties in a layoff dispute, the judge's considerations in deciding the case, and the legal consequences of such termination. This study uses a normative juridical method with a case study of court decisions and an analysis of applicable labor regulations, including Law Number 13 of 2003, the Job Creation Law, and Government Regulation No. 35 of 2021. The results show that the actions of workers who accept gratuities without the permission of company management are classified as serious violations, so unilateral termination is considered legally valid if it meets formal procedures. The judge considers ethical violations, the principle of honesty, and potential losses to the company. The study recommends that companies clarify antigratuity policies and increase business ethics education for employees to prevent similar cases from recurring. The judge in this case considered aspects of ethical violations, compliance with internal company regulations, and protection of the company's integrity. Fair and firm law enforcement is necessary to protect company rights without compromising employee protections.
