Perbuatan Melawan Hukum terhadap Hak Penguasaan Tanah Tanpa Izin ( Studi Putusan Pengadilan Negeri 924/PDT.G/2022/PN-Mdn)

Abstract

Pemanfaatan tanah tanpa izin dari pemilik yang sah merupakan bentuk perbuatan melawan hukum, misalnya mendirikan bangunan di atas tanah milik orang lain tanpa persetujuan. Tindakan ini menimbulkan kerugian bagi pemegang hak atas tanah. Penelitian ini bertujuan mengkaji perbuatan melawan hukum dalam penguasaan tanah tanpa izin elalui studi Putusan Pengadilan Negeri Medan Nomor 924/Pdt.G/2022/PN Mdn. Rumusan masalah meliputi: Bagaimana pengaturan hukum mengenai penguasaan tanah di Indonesia; Apa faktor penyebab terjadinya penguasaan tanah tanpa izin; serta Bagaimana pertimbangan hakim dalam memutus perkara tersebut.Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan kasus, berdasarkan peraturan perundang-undangan, studi dokumen, dan wawancara. Hasil penelitian menunjukkan bahwa penguasaan tanah diatur dalam Undang-Undang Nomor 5 Tahun 1960 tentang Pokok-Pokok Agraria (UUPA) dan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah. Namun, praktik penguasaan tanah tanpa izin masih sering terjadi akibat faktor ekonomi kepentingan usaha, serta rendahnya pemahaman hukum. Dalam perkara yang diteliti, majelis hakim merujuk Pasal 1365 KUHPerdata dan menilai bahwa tergugat telah menguasai tanah tanpa hak, sehingga memenuhi unsur perbuatan melawan hukum Hakim memutuskan tergugat wajib mengganti kerugian, menegaskan pentingnya perlindungan hukum terhadap pemilik tanah dan bahwa setiap bentuk penguasaan tanah harus berdasarkan hak atau izin yang sah. The utilization of land without the permission of the rightful owner constitutes an unlawful act, such as constructing a building on another person's land without consent. Such actions cause harm to the legitimate landowner. This study aims to examine unlawful acts in unauthorized land control through the case study of District Court Decision No. 924/Pdt.G/2022/PN Mdn. The research problems include: how land ownership is regulated in Indonesia; what factors lead to unauthorized landcontrol; and how the judge considered the unlawful act in resolving the case. The research method applied is normative juridical with a case approach, based on statutory regulations, document analysis, an d interviews, using descriptive qualitative analysis. The findings reveal that land control in Indonesia is governed by Law No. 5 of 1960 on the Basic Agrarian Law (UUPA) and Government Regulation No. 24 of 1997 on Land Registration. However, unauthorized land control remains prevalent due to economic factors, business interests, and low public awareness of land law. In the case studied, the panel of judges referred to Article 1365 of the Indonesian Civil Code and concluded that the defendant had unlawfully controlled land without rights, thereby fulfilling the elements of an unlawful act. The court ordered the defendant to compensate the landowner, affirming the importance of legal protection for land rights holders and emphasizing that any form of land control must be based on valid rights or lawful authorization.
