dc.description.abstractPailit yang merupakan keadaan di mana debitur tidak mampu untuk melakukan pembayaran terhadap utang-utangnya kepada kreditur. Penelitian ini bertujuan untuk mengetahui pengaturan hukum bagi kurator di Indonesia dan menganalisis tanggung jawab hukum yang melekat pada kurator dalam hal terjadi kerugian selama proses pengurusan dan pemberesan harta pailit, dengan menyoroti pengaturan hukum yang berlaku, pelaksanaan peran kurator, serta hambatan yang umum dihadapi. Berdasarkan pendekatan yuridis normatif dan wawancara dengan praktisi, ditemukan bahwa kurator memiliki tanggung jawab penuh sebagaimana diatur dalam Undang-Undang Nomor 37 Tahun 2004. Apabila terbukti lalai atau melakukan wanprestasi, kurator dapat digugat secara perdata atas dasar perbuatan melawan hukum. Hambatan yang sering muncul meliputi keterbatasan data aset, konflik kepentingan, serta lemahnya pengawasan dari hakim pengawas. Penelitian ini menyimpulkan bahwa perlunya penegakan integritas dan profesionalitas kurator, serta sistem pengawasan yang lebih ketat dan transparan dari lembaga peradilan. Oleh karena itu, disarankan agar dibentuk mekanisme evaluasi kinerja kurator secara berkala dan pembaruan regulasi yang menegaskan standar kelayakan profesional, guna menghindari kerugian lebih lanjut terhadap para pihak yang terlibat dalam sengketa kepailitan. Bankruptcy is a condition in which a debtor is unable to fulfil payment obligations to creditors. This study aims to examine the legal framework governing bankruptcy trustees (curators) in Indonesia and to analyse the legal liability attached to trustees in the event of losses arising during the management and settlement of bankruptcy estates. The research highlights the applicable legal provisions, the implementation of the trustee’s role, as well as common obstacles encountered in practice. Based on a normative juridical approach and interviews with practitioners, it was found that trustees bear full responsibility as stipulated under Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations. If proven negligent or in breach of duty, trustees may be sued in civil court on the basis of unlawful conduct. Frequent obstacles include incomplete asset data, conflicts of interest, and weak oversight by supervising judges. This study concludes that it is necessary to strengthen the integrity and professionalism of trustees, supported by stricter and more transparent judicial supervision. Therefore, it is recommended that a periodic performance evaluation mechanism be established and that regulatory updates clarify professional standards, in order to prevent further losses for parties involved in bankruptcy proceedings.en_US
