| Abstract: | Penelitian ini bertujuan untuk menganalisis secara yuridis pelaksanaan peralihan piutang (cessie) melalui notaris sebagai alternatif penyelesaian kredit bermasalah. Peralihan piutang atau cessie merupakan mekanisme hukum yang memungkinkan pengalihan hak tagih dari kreditur lama kepada kreditur baru, sebagaimana diatur dalam Pasal 613 Kitab Undang-Undang Hukum Perdata (KUHPerdata). Praktik ini tidak hanya berkembang dalam sektor perbankan, tetapi juga mulai digunakan oleh pelaku usaha, lembaga pembiayaan, dan entitas lain sebagai strategi mitigasi terhadap risiko gagal bayar. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan dan studi kepustakaan, serta didukung wawancara dengan Notaris di Kantor Notaris & PPAT Putri AR, S.H., M.Kn. Hasil penelitian menunjukkan bahwa meskipun pengaturan cessie telah ada secara normatif, pelaksanaannya masih menghadapi sejumlah kendala, seperti terbatasnya pemahaman debitur terhadap akibat hukum cessie, serta belum adanya pengaturan teknis yang komprehensif. Notaris berperan penting dalam menjamin keabsahan formil akta cessie, memberikan perlindungan hukum, serta memastikan terpenuhinya asas transparansi dan legalitas. Oleh karena itu, sinkronisasi regulasi dan peningkatan literasi hukum kepada para pihak yang terkait sangat diperlukan. Dengan dukungan notaris yang profesional dan regulasi yang lebih adaptif, cessie dapat menjadi salah satu solusi efektif dalam menyelesaikan kredit bermasalah serta menjamin kepastian dan perlindungan hukum bagi semua pihak. This study aims to analyze the legal implementation of receivables transfer (cessie) through a notary as an alternative solution to non-performing loans. The transfer of receivables, or cessie, is a legal mechanism that enables the assignment of debt claims from the original creditor to a new one, as regulated under Article 613 of the Indonesian Civil Code (KUHPerdata). This practice has not only developed within the banking sector but has also been increasingly adopted by business actors, financing institutions, and other entities as a strategy to mitigate the risk of default. This research employs a normative juridical method with a statutory and literature approach, supported by interviews conducted with a Notary at the Office of Notary & Land Deed Official (PPAT) Putri AR, S.H., M.Kn. The findings reveal that although the legal framework for cessie is normatively established, its practical implementation still faces several challenges, including limited understanding among debtors regarding the legal consequences of cessie, and the absence of comprehensive technical regulations. Notaries play a vital role in ensuring the formal validity of cessie deeds, providing legal protection, and upholding the principles of transparency and legality. Therefore, regulatory harmonization and enhanced legal literacy among stakeholders are essential. With professional notarial support and more adaptive regulations, cessie can serve as an effective solution for resolving non-performing loans while ensuring legal certainty and protection for all parties involved. |
