Peran Kepolisian Resort Kota Medan dalam Menerapkan Restorative Justice Sebagai Pemenuhan Asas ultimum Remedium tentang kecelakaan Lalu Lintas (Studi Kasus Satlantas Polresta Wilayah Medan)

Abstract

Pada perkembangannya, lalu lintas jalan dapat menjadi masalah bagi manusia, dan semakin besarnya masyarakat yang menggunakan sarana transportasi angkutan jalan, maka hal inilah yang akan mempengaruhi tinggi rendahnya angka kecelakaan lalu lintas. Penelitian ini didasari oleh pentingnya penerapan pendekatan restorative justice sebagai solusi alternatif penyelesaian perkara pidana, keadilan restoratif atau keadilan pemulihan (restorative justice) merupakan suatu model pendekatan baru dalam upaya penyelesaian perkara pidana. Berbeda dengan sistem pidana tradisional, pendekatan atau konsep keadilan restoratif atau keadilan pemulihan (restorative justice) lebih menitikberatkan pada adanya partisipasi langsung dari pelaku, korban dan masyarakat dalam proses penyelesaian perkara pidana. khususnya dalam kasus kecelakaan lalu lintas yang tidak mengakibatkan korban jiwa. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis bagaimana peran Kepolisian Resort Kota Medan dalam menerapkan restorative justice, serta bagaimana pelaksanaan restorative justice diterapkan dalam penyelesaian kasus kecelakaan lalu lintas. Metode yang digunakan dalam penelitian ini adalah metode yuridis empiris, dengan pendekatan kualitatif, melalui studi pustaka dan wawancara dengan pihak Kepolisian Resort Kota Medan. Hasil penelitian menunjukkan bahwa peran Polres Medan sangat penting dalam mendukung keadilan restoratif, terutama melalui tahapan asesmen perkara, mediasi antara korban dan pelaku, serta pembuatan berita acara perdamaian yang menjadi dasar diterbitkannya Surat Perintah Penghentian Penyidikan (SP3). increasing number of people using road transportation means, this is what will affect the high and low number of traffic accidents. This research is motivated by the importance of implementing a restorative justice approach as an alternative solution to resolving criminal cases, restorative justice is a new approach model in efforts to resolve criminal cases. In contrast to the traditional criminal system, this approach or concept of restorative justice emphasizes the direct participation of perpetrators, victims and the community in the process of resolving criminal cases, especially in traffic accident cases that do not result in fatalities. The purpose of this study is to determine and analyze the role of the Medan City Resort Police in the application of restorative justice, as well as how the application of restorative justice in resolving traffic accident cases. The method used in this study is an empirical juridical method, with a qualitative approach, through literature studies and interviews with the Medan City Resort Police. The results of the study show that the role of the Medan City Police is very important in supporting restorative justice, especially through the stages of case assessment, mediation between the victim and the perpetrator, and the preparation of a peace report which becomes the basis for issuing an Investigation Termination Order (SP3).
