dc.description.abstractPenelitian ini menganalisis aspek hukum wanprestasi dalam peralihan kredit kendaraan bermotor pada perjanjian sewa guna usaha di Federal International Finance (FIF) Group Medan. Wanprestasi dalam perjanjian leasing dapat terjadi akibat kelalaian debitur dalam memenuhi kewajibannya, seperti keterlambatan pembayaran, pengalihan kredit tanpa persetujuan, atau pelanggaran ketentuan kontrak lainnya. Studi ini menggunakan pendekatan yuridis normatif dan yuridis empiris untuk mengkaji regulasi hukum yang mengatur wanprestasi serta praktik yang terjadi di lapangan. Data diperoleh melalui studi literatur serta wawancara dengan pihak FIF Group Medan, termasuk manajer leasing dan debitur. Hasil penelitian menunjukkan bahwa wanprestasi dalam peralihan kredit kendaraan bermotor berpotensi menimbulkan konsekuensi hukum bagi debitur maupun kreditur, termasuk penarikan kendaraan dan sanksi finansial. Selain itu, proses penyelesaian sengketa dalam kasus wanprestasi sering kali melibatkan mekanisme hukum seperti negosiasi, mediasi, atau litigasi. Oleh karena itu, diperlukan langkah-langkah preventif oleh FIF Group untuk mengurangi risiko wanprestasi, seperti meningkatkan transparansi perjanjian, memperketat persyaratan pengalihan kredit, dan mengoptimalkan mekanisme penyelesaian sengketa guna melindungi kepentingan semua pihak yang terlibat. This study analyzes the legal aspects of default in the transfer of motor vehicle loans to lease agreements in Federal International Finance (FIF) Group Medan. Default in a leasing agreement can occur due to the debtor's negligence in fulfilling its obligations, such as late payment, transfer of credit without approval, or violation of other contractual provisions. This study uses normative juridical and empirical juridical approaches to examine legal regulations that govern defaults and practices that occur in the field. The data was obtained through literature studies and interviews with FIF Group Medan, including leasing managers and debtors. The results of the study show that default in the transfer of motor vehicle loans has the potential to have legal consequences for debtors and creditors, including vehicle withdrawals and financial sanctions. In addition, the dispute resolution process in default cases often involves legal mechanisms such as negotiation, mediation, or litigation. Therefore, preventive measures are needed by the FIF Group to reduce the risk of default, such as increasing the transparency of agreements, tightening credit transfer requirements, and optimizing dispute resolution mechanisms to protect the interests of all parties involved.en_US
