| Abstract: | Maraknya penyalahgunaan BBM bersubsidi, khususnya solar, yang merugikan negara dan masyarakat. Subsidi BBM yang seharusnya ditujukan untuk membantu golongan ekonomi rendah, justru disalahgunakan oleh oknum tertentu untuk keuntungan pribadi. Adanya regulasi dan aturan yang mengatur tentang minyak bumi dan gas tersebut, nyatanya belum mampu meningkatkan peran pendistribusian Minyak dan Gas Bumi ke masyarakat. Penelitian ini menggunakan yuridis normatif, dengan data sekunder berupa bahan hukum primer (UU Migas, KUHP, Peraturan Presiden terkait BBM) dan bahan hukum sekunder (buku, jurnal, artikel, dan dokumen terkait). Hasil penelitian menunjukkan bahwa aturan hukum terhadap tindak pidana penyertaan menyalahgunakan niaga bahan bakar solar di Indonesia sangat jelas dan tegas. Undang-Undang Republik Indonesia Nomor. 6 tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti UU No. 2 tahun 2022 tentang Cipta Kerja jo Pasal 55 (1) ke – 1 KUHP. Hakim menyatakan bahwa terdakwa Canro Hottua Sihotang dan Kinoy terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana "Turut serta melakukan perbuatan menyalahgunakan niaga bahan bakar gas yang di subsidi pemerintah". Putusan menegaskan bahwa aturan hukum tersebut di Indonesia sangat jelas dan tegas. meskipun, terdapat tantangan dalam penegakan hukum, seperti kesulitan dalam mengumpulkan bukti dan kompleksitas hukum. The rampant misuse of subsidized fuel, especially diesel, is detrimental to the state and society. Fuel subsidies, which were supposed to help the low economic class, were actually misused by certain individuals for personal gain. The existence of regulations and rules governing oil and gas, in fact, has not been able to increase the role of distributing oil and gas to the community. This research uses normative juridical, with secondary data in the form of primary legal materials (Oil and Gas Law, Criminal Code, Presidential Regulations related to fuel) and secondary legal materials (books, journals, articles, and related documents). The results of the study show that the legal rules against the crime of participating in the abuse of diesel fuel in Indonesia are very clear and firm. Law of the Republic of Indonesia Number. 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law No. 2 of 2022 concerning Job Creation jo Article 55 (1) to – 1 of the Criminal Code. The judge stated that the defendants Canro Hottua Sihotang and Kinoy were legally and convincingly proven guilty of committing the crime of "participating in the act of abusing the government-subsidized gas fuel trade". The verdict confirms that the rule of law in Indonesia is very clear and firm. However, there are challenges in law enforcement, such as difficulties in gathering evidence and legal complexity. |
