dc.description.abstractPenelitian ini bertujuan untuk mengkaji secara yuridis kedudukan Grant Sultan Deli sebagai alas hak dalam pelaksanaan pembangunan Jalan Tol Medan–Binjai, dengan fokus pada analisis terhadap Putusan Nomor 724/Pdt.G/2023/PN Mdn. Grant Sultan Deli, yang merupakan hak waris Kesultanan Deli atas sejumlah tanah di wilayah Sumatera Utara, sering kali menjadi objek sengketa dalam proyekproyek strategis nasional, termasuk pembangunan infrastruktur jalan tol. Dalam penelitian ini digunakan pendekatan yuridis normatif dan yuridis empiris, dengan mengkaji peraturan perundang-undangan terkait hak atas tanah, serta melakukan telaah terhadap fakta-fakta hukum dalam putusan pengadilan. Hasil penelitian menunjukkan bahwa eksistensi Grant Sultan Deli sebagai alas hak memiliki kelemahan dari aspek legal formal, terutama terkait pengakuan dan pendaftaran dalam sistem pertanahan nasional. Dalam perkara yang diperiksa, majelis hakim menilai bahwa bukti kepemilikan yang diajukan berdasarkan Grant Sultan Deli tidak memenuhi kualifikasi sebagai alas hak yang sah menurut hukum positif Indonesia. Kesimpulan dari penelitian ini menunjukkan bahwa perlindungan hukum terhadap pemegang Grant Sultan Deli masih lemah, serta dibutuhkan rekonstruksi regulasi dan tata kelola hak ulayat dan tanah adat untuk menghindari konflik agraria di masa mendatang. This study investigates the legal status of the Grant Sultan Deli as a basis for land rights in the context of the Medan–Binjai Toll Road development, with a particular focus on the analysis of Court Decision No. 724/Pdt.G/2023/PN Mdn. The Grant Sultan Deli, representing hereditary land entitlements historically attributed to the Deli Sultanate in North Sumatra, has recurrently emerged as a contested basis of land claims in the implementation of national strategic infrastructure projects. Employing both normative and empirical juridical methodologies, this research reviews applicable land legislation and analyzes the judicial reasoning presented in the aforementioned court decision. The findings indicate that the legal foundation of the Grant Sultan Deli is tenuous from a formal legal standpoint, particularly due to its lack of recognition and integration within the national land registration system. In the case examined, the judicial panel determined that the documentation based on the Grant Sultan Deli failed to satisfy the evidentiary standards required to establish valid legal ownership under Indonesian positive law. The study concludes that legal protections for holders of Grant Sultan Deli titles remain insufficient, and underscores the urgent need for regulatory reform and enhanced governance mechanisms to ensure the equitable recognition of traditional and customary land rights, thereby mitigating the risk of future agrarian disputes.en_US
