dc.description.abstractPersekongkolan tender merupakan salah satu bentuk persaingan usaha tidak sehat yang berpotensi merugikan negara maupun masyarakat. Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat, khususnya Pasal 22, secara tegas melarang adanya kerja sama antar pelaku usaha untuk menentukan pemenang tender, karena tindakan tersebut merusak mekanisme pasar, meniadakan persaingan yang sehat, dan menciptakan harga yang tidak wajar. Pelaku usaha yang melakukan persekongkolan biasanya menciptakan kesan persaingan dengan memasukkan beberapa penawaran yang seolah-olah bersaing, padahal semuanya telah diatur agar pihak tertentu yang memenangkan tender tersebut. Masalah dalam penelitian ini difokuskan pada bagaimana bentuk persekongkolan tender yang terjadi di PLN Area Rantau Prapat, dampak yang ditimbulkan dari praktik tersebut terhadap negara maupun masyarakat, serta analisis hukum terhadap persekongkolan tender dan pemborongan pekerjaan pelayanan teknik yang dilakukan oleh para terlapor. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan analisis data secara kualitatif. persekongkolan tender di PLN Area Rantau Prapat dilakukan melalui kerja sama horizontal antar penyedia jasa dan vertikal dengan panitia pengadaan, sehingga menimbulkan persaingan semu. Praktik ini berdampak pada kerugian negara karena biaya menjadi tidak efisien, kualitas pekerjaan menurun, serta mengurangi kepercayaan publik terhadap proses pengadaan. Bid-rigging is a form of unfair business competition that can harm both the state and society. Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair Business Competition, particularly Article 22, strictly prohibits cooperation between business actors to determine the winner of a tender, as such actions damage market mechanisms, eliminate fair competition, and create unreasonable prices. Business actors involved in bid-rigging usually create the appearance of competition by submitting several offers that seem to compete, even though they have already been arranged so that a certain party will win the tender. This research focuses on how bid-rigging took place in PLN Area Rantau Prapat, the impacts of such practices on the state and society, and the legal analysis of bid-rigging and contracting of technical service works carried out by the reported parties. The research method used is normative juridical research with qualitative data analysis. The bid-rigging at PLN Area Rantau Prapat was carried out through horizontal cooperation among service providers and vertical cooperation with the procurement committee, resulting in artificial competition. This practice caused losses to the state because costs became inefficient, work quality decreased, and public trust in the procurement process declined.en_US
