dc.description.abstractPenelitian ini mengkaji pertanggungjawaban hukum pidana terhadap pelaku tindak pidana turut serta dalam pengangkutan dan penjualan bahan bakar minyak (BBM) solar bersubsidi, Guna mengetahui pengaturan hukum dan pertanggungjawaban pidana serta mengetahui pertimbangan hukum terhadap putusan pengadilan. Hasil penelitian menunjukkan bahwa pengaturan hukum mengenai pertanggungjawaban pidana dalam pengangkutan dan penjualan BBM solar bersubsidi di Indonesia telah diatur secara tegas, untuk melindungi distribusi subsidi agar tepat sasaran. Pelaku dijerat Undang-Undang Nomor 22 Tahun 2001 tentang Minyak dan Gas Bumi sebagaimana diubah oleh Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja, dan ketentuan Pasal 55 ayat (1) ke-1 KUHP mengenai turut serta. Dalam putusan Nomor 125/Pid.Sus/2023/PN.Ksp, majelis hakim mempertimbangkan peran serta subsidi, serta adanya kesadaran dan kehendak untuk memperoleh keuntungan ekonomi secara melawan hukum. Dengan demikian, perlu penegakan yang lebih tegas dan pidana yang lebih berat agar tujuan hukum pidana dapat tercapai secara optimal, khususnya dalam melindungi hak masyarakat penerima subsidi. This study examines the criminal legal accountability of perpetrators involved in the transportation and sale of subsidized diesel fuel (BBM), aiming to understand the legal regulations and criminal responsibility, as well as the judicial considerations in court decisions. The findings indicate that the legal framework governing criminal liability in the transportation and sale of subsidized diesel fuel in Indonesia is clearly regulated to ensure that subsidy distribution is properly targeted. Perpetrators are prosecuted under Law Number 22 of 2001 concerning Oil and Gas, as amended by Law Number 11 of 2020 on Job Creation, along with the provisions of Article 55 paragraph (1) number 1 of the Criminal Code concerning participation. In Decision Number 125/Pid.Sus/2023/PN.Ksp, the panel of judges took into account the role of participation in the subsidy, as well as the awareness and intent to obtain unlawful economic gain. Therefore, stricter enforcement and heavier penalties are necessary to optimally achieve the objectives of criminal law, particularly in protecting the rights of the subsidy recipients.en_US
