| Abstract: | Penadahan barang hasil pencurian ialah salah satu bentuk dari perilaku menyimpang yang selalu ada dan melekat dalam setiap masyarakat, karena itu penadahan barang curian merupakan salah satu fenomena sosial yang dapat terjadi dimanapun dan pada siapapun. Salah satu peristiwa tindak pidana penadahan barang hasil curian yang terjadi di tengah masyarakat dan menimbulkan kerugian bagi korban yakni dalam Putusan Nomor : 320/Pid.B/2023/PN.Mdn. Permasalahan dalam penulisan ini yakni bagaimana penerapan pidana terhadap pelaku yang melakukan tindak pidana penadahan dan bagaimana pertanggungjawaban pidana terhadap pelaku yang melakukan tindak pidana penadahan sesuai dengan putusan nomor: 320/Pid.B/2023/PN.Mdn. Pendekatan yang dilakukan dalam penelitian ini adalah secara yuridis normatif. Faktor penyebab Terdakwa melakukan tindak pidana penadahan disebabkan faktor ekonomi, pendidikan, lingkungan dan rendahnya kesadaran hukum dari diri terdakwa. Akibat perbuatan yang telah dilakukan oleh Terdakwa, korban mengalami kerugian sebesar Rp.10.000.000,- (sepuluh juta rupiah). Hasil penelitian menunjukkan bahwa penerapan pidana terhadap terdakwa telah sesuai dengan unsur-unsur Pasal 480 ke-1 KUHP tentang penadahan. Majelis hakim menjatuhkan pidana penjara kepada terdakwa sebagai bentuk pertanggungjawaban pidana yang menegaskan efek jera, memutus mata rantai kejahatan, dan memberikan kepastian hukum. Receiving stolen goods is a form of deviant behavior that always exists and is inherent in every society, therefore receiving stolen goods is a social phenomenon that can occur anywhere and to anyone. One of the criminal acts of receiving stolen goods that occurred in the community and caused losses to the victim is in Decision Number: 320 / Pid.B / 2023 / PN.Mdn. The problem in this writing is how to apply criminal penalties to perpetrators who commit the crime of receiving stolen goods and how to be criminally responsible for perpetrators who commit the crime of receiving stolen goods in accordance with decision number: 320 / Pid.B / 2023 / PN.Mdn. The approach taken in this study is normative juridical. The factors causing the Defendant to commit the crime of receiving stolen goods are due to economic factors, education, environment and low legal awareness of the defendant. As a result of the actions committed by the Defendant, the victim suffered a loss of Rp. 10,000,000 (ten million rupiah). The research results indicate that the application of the criminal penalty to the defendant complies with the elements of Article 480, point 1 of the Criminal Code concerning receiving stolen goods. The panel of judges sentenced the defendant to prison as a form of criminal accountability that emphasizes a deterrent effect, breaks the chain of crime, and provides legal certainty. |
