Tanggung Jawab Perusahaan Sektor Perkebunan dalam Pembayaran Upah Lembur Tenaga Kerja ( Studi pada Perkebunan Dagang dan Industri Soeloeng Laoet)

Abstract

Hubungan kerja tidak dapat terlepas dari unsur upah, karena upah merupakan salah satu unsur dari hubungan kerja. Apabila pekerja sudah bersedia bekerja melampaui batas waktu maka pekerja/buruh tersebut berhak memperoleh upah lembur. Masalah dalam penelitian ini difokuskan pada Pengaturan tentang Upah Lembur, Persyaratan pembayaran upah lembur, Tanggung Jawab Perusahaan PT. Perkebunan Dagang dan Industri Soelong Laoet dalam Pembayaran Upah Lembur Tenaga Kerja Berdasarkan Peraturan Pemerintah Nomor 35 Tahun 2021. Metode penelitian yang digunakan dalam penelitian ini yaitu yuridis normatif, hasil dari penelitian ini menunjukkan bahwa Pengaturan tentang upah lembur tenaga kerja di Indonesia telah diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, Peraturan Pemerintah Nomor 35 Tahun 2021, Peraturan Pemerintah Nomor 36 Tahun 2021 tentang pengupahan, dan peraturan lainnya, Pembayaran upah lembur dalam perusahaan sektor perkebunan wajib diberikan kepada pekerja yang bekerja melebihi waktu kerja normal, serta perhitungannya didasarkan pada gaji pokok dan tunjangan tetap, Tanggung Jawab Perusahaan PT. Perkebunan Dagang dan Industri Soeloeng Laoet dalam Pembayaran Upah Lembur Tenaga Kerja Berdasarkan Peraturan Pemerintah Nomor 35 Tahun 2021 adalah perusahaan memiliki kewajiban hukum dalam membayar upah lembur kepada tenaga kerjanya sesuai ketentuan Peraturan Pemerintah Nomor 35 Tahun 2021. The employment relationship cannot be separated from the element of wages, because wages are one of the elements of the employment relationship. If the worker is willing to work beyond the specified hours, then the worker/laborer is entitled to receive overtime pay. The issues in this research focus on the Regulation of Overtime Pay, the Requirements for Overtime Pay, and the Responsibilities of PT. Perkebunan Dagang dan Industri Soelong Laoet in Paying Overtime Wages to Workers Based on Government Regulation Number 35 of 2021. The research method used in this study is normative juridical. The results of this study indicate that the regulation of overtime wages for workers in Indonesia has been stipulated in LawNumber 13 of 2003 concerningManpower, Government Regulation Number 35 of 2021, Government Regulation Number 36 of 2021 concerning wages, Ministerial Regulation Number 102/MEN/VI/2004, and other regulations. Overtime wages in plantation sector companies must be paid to workers who work beyond normal working hours, and the calculation is based on the basic salary and fixed allowances. The responsibility of PT. Perkebunan Dagang dan Industri Soeloeng Laoet in paying overtime wages to workers based on Government Regulation Number 35 of 2021 is that the company has a legal obligation to pay overtime wages to its workers in accordance with the provisions of Government Regulation Number 35 of 2021.
