Abstract: Pertambangan ilegal merugikan negara dan merusak lingkungan. Pasal 158 jo Pasal 35 UU No. 3 Tahun 2020 mengatur bahwa pertambangan tanpa izin merupakan tindak pidana, sementara Pasal 55 ayat (1) ke-1 KUHP menjerat pihak yang turut serta dalam kejahatan ini. Namun, lemahnya pengawasan, ketidaksesuaian regulasi, dan praktik korupsi masih menjadi tantangan dalam penegakan hukum. Diperlukan kebijakan yang lebih tegas dan koordinasi yang efektif untuk memastikan pengelolaan sumber daya alam berjalan secara legal dan berkelanjutan. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif, yaitu penelitian yang dilakukan dengan mempelajari norma-norma atau peraturan Perundang-undangan yang terkait dengan permasalahan yang dibahas. Sifat peelitian dalam skripsi penelitian ini adalah deskriptif analitis berdasarkan studi putusan kasus. Hasil penelitian dari Penelitian ini yaitu, Penambangan adalah eksploitasi sumber daya alam yang harus dikelola bijak sesuai regulasi. UU Pertambangan mengatur tahapan dan perizinan, sementara kasus Erwin Syahputra menegaskan bahwa pertambangan tanpa izin adalah tindak pidana. Pemerintah menerbitkan izin seperti IPR dengan mempertimbangkan lingkungan dan masyarakat. Majelis hakim menilai Erwin Syahputra Rambe terbukti bersalah melakukan pertambangan tanpa izin sesuai Pasal 158 jo Pasal 35 UU No. 3 Tahun 2020 dan Pasal 55 ayat (1) ke-1 KUHP. Keterlibatan alat berat dan pihak lain menunjukkan ia tidak bertindak sendiri. Penegakan hukum pertambangan masih menghadapi tantangan seperti regulasi yang tidak sinkron, korupsi, dan rendahnya kesadaran masyarakat. Kebijakan harus berlandaskan kepentingan publik dan keberlanjutan, sementara hakim wajib mempertimbangkan faktor hukum dan nilai keadilan dalam putusan. Illegal mining harms the state and damages the environment. Article 158 in conjunction with Article 35 of Law No. 3 of 2020 regulates that mining without permit is a criminal act, while Article 55 paragraph (1) point 1 of the Criminal Code ensnares parties who participate in this crime. However, weak supervision, regulatory mismatch, and corruption practices are still challenges in law enforcement. Strict policies and effective coordination are needed to ensure the management of natural resources runs legally and sustainably. The research method that was used in this research was normative juridical, namely research that was conducted by studying norms or laws and regulations related to the discussed problems. The nature of the research in this research thesis was analytical descriptive based on a case decision study. The research results of this research were that mining was the exploitation of natural resources that had to be managed wisely according to regulations. Mining Law regulated the stages and licensing, while the case of Erwin Syahputra emphasized that mining without permit was a criminal act. The government issued permits such as IPR by considering the environment and society. The panel of judges assessed that Erwin Syahputra Rambe was proven guilty of carrying out mining without permit according to Article 158 in conjunction with Article 35 of Law No. 3 of 2020 and Article 55 paragraph (1) point 1 of the Criminal Code. The involvement of heavy equipment and other parties showed he did not act alone. Law enforcement in mining still faced challenges such as unsynchronized regulations, corruption, and low public awareness. Policies are based on public interest and sustainability, while judges are obliged to consider legal factors and the value of justice in decisions.
