Abstract: Permasalahan tenaga kerja atau perburuhan merupakan permasalahan yang khas kita dengar bagi negara berkembang, termasuk Indonesia. Terkait dalam hal tersebut, pemutusan hubungan kerja (PHK) adalah salah satunya. Rumusan masalah yang diangkat adalah bagaimana mekanisme, pertimbangan hakim dalam putusan No. 17/Pdt.Sus-PHI/2024/PN.Mdn dan bagaimana akibat hukum dan upaya hukum terhadap pemberian uang pengganti hak kepada pekerja kontrak dalam hal telah terjadinya pemutusan hubungan sepihak. Jenis penelitian ini menggunakan pendekatan yuridis normatif dan yuridis empiris dengan metode deskriptif-analitis. Data diperoleh melalui studi pustaka terhadap peraturan perundang-undangan dan doktrin hukum, serta data primer melalui studi lapangan. Hasil penelitian menunjukkan bahwa PHK yang dilakukan oleh perusahaan tanpa dasar hukum yang sah, sebagaimana dalam perkara a quo, bertentangan dengan prinsip perlindungan hukum bagi tenaga kerja. Sengketa PHK sepihak terhadap pekerja kontrak yang diselesaikan melalui proses bipartit, mediasi, hingga pengadilan. Penggugat berhak atas uang pesangon, uang penghargaan masa kerja, uang penggantian hak, serta upah proses selama tidak dipekerjakan. Penelitian ini merekomendasikan penguatan pengawasan terhadap pelaksanaan hubungan kerja berbasis kontrak, serta perlunya sosialisasi hukum ketenagakerjaan yang lebih intensif kepada pelaku usaha dan tenaga kerja guna mencegah terjadinya pelanggaran serupa di masa mendatang, serta menekankan peran pengawasan dan edukasi hukum dalam menciptakan hubungan industrial yang harmonis. Labor issues are typical in developing countries, including Indonesia. Termination of employment (PHK) is one such issue. The problem formulation raised concerns the mechanism, the judge's considerations in decision No. 17/Pdt.Sus- PHI/2024/PN.Mdn, and the legal consequences and remedies for granting compensation to contract workers in the event of unilateral termination. This research uses a normative and empirical juridical approach using a descriptiveanalytical method. Data were obtained through a literature review of laws and legal doctrines, as well as primary data through field studies. The results indicate that layoffs carried out by companies without a valid legal basis, as in the case a quo, violate the principle of legal protection for workers. The dispute over unilateral layoffs of contract workers was resolved through bipartite processes, mediation, and the courts. The plaintiffs are entitled to severance pay, long-service bonuses, compensation for rights, and wages for the time they were not employed. This study recommends strengthening supervision of the implementation of contract-based employment relationships, as well as the need for more intensive socialization of labor law to businesses and workers to prevent similar violations in the future. It also emphasizes the role of supervision and legal education in creating harmonious industrial relations.
