Abstract: Penelitian ini bertujuan untuk menganalisis aspek hukum pengalihan piutang (cessie) yang dilakukan oleh Cessionaris dalam konteks perjanjian kredit yang melibatkan hak tanggungan, dengan fokus pada Putusan Nomor 15/PDT.G/2022/PN.BNJ. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dan studi kasus, yang mengkaji penerapan hukum dalam praktik pengalihan piutang serta implikasinya terhadap hak dan kewajiban para pihak yang terlibat. Hasil penelitian menunjukkan bahwa pengalihan piutang melalui cessie dapat dilakukan tanpa memerlukan persetujuan debitur, asalkan memenuhi syarat formal yang ditetapkan dalam Pasal 613 Kitab Undang-Undang Hukum Perdata (KUHPerdata). Dalam kasus ini, Cessionaris telah memenuhi kewajiban untuk memberikan pemberitahuan kepada debitur, sehingga pengalihan piutang dianggap sah dan memiliki kekuatan hukum. Selain itu, prinsip accessoir dalam Undang-Undang No. 4 Tahun 1996 tentang Hak Tanggungan memastikan bahwa hak tanggungan tetap melekat pada piutang yang dialihkan, memberikan Cessionaris hak untuk menagih dan mengeksekusi jaminan jika debitur wanprestasi. Penelitian ini juga mengidentifikasi tantangan yang dihadapi Cessionaris dalam proses pengalihan piutang, termasuk resiko wanprestasi debitur dan potensi sengketa hukum. Oleh karena itu, disarankan agar Cessionaris melakukan due diligence yang menyeluruh sebelum menerima pengalihan piutang, serta memastikan bahwa semua dokumen dan prosedur hukum dipatuhi untuk melindungi hak-hak mereka. Temuan ini diharapkan dapat memberikan kontribusi bagi pengembangan hukum terkait pengalihan piutang di Indonesia dan meningkatkan pemahaman mengenai praktik hukum yang baik dalam transaksi keuangan. This research aims to analyze the legal aspects of the transfer of receivables (cessie) carried out by the Cessionaris in the context of a credit agreement involving a mortgage, focusing on Decision Number 15/PDT.G/2022/PN.BNJ. The research method used is a normative juridical approach and case study, which examines the application of law in the practice of transferring receivables and its implications for the rights and obligations of the parties involved. The results show that the transfer of receivables through cessie can be carried out without requiring the debtor's consent, provided that it fulfills the formal requirements set out in Article 613 of the Civil Code (KUHPerdata). In this case, the cessionary has fulfilled the obligation to give notice to the debtor, so that the transfer of receivables is considered valid and has legal force. In addition, the accessoir principle in Law No. 4 of 1996 on Mortgage Rights ensures that the mortgage rights remain attached to the transferred receivables, giving the Cessionaris the right to collect and execute the collateral if the debtor defaults. This research also identifies the challenges faced by cessionaries in the receivables transfer process, including the risk of debtor default and potential legal disputes. Therefore, it is recommended that cessionaries conduct thorough due diligence before accepting an assignment of receivables, and ensure that all legal documents and procedures are followed to protect their rights. The findings are expected to contribute to the development of laws related to the transfer of receivables in Indonesia and improve the understanding of good legal practices in financial transactions.
