Abstract: Tujuan kajian ini membahas mengenai penerapan prinsip mengenal nasabah dalam pemberian pembiayaan usaha bank syariah dengan memperhatikan prinsip 5C dan prinsip 5P. Rumusan masalah pada penelitian ini adalah pertama bagaimana pengaturan hukum tentang pembiayaan usaha pada Bank Syariah Indonesia, kedua bagaimana penerapan prinsip mengenal nasabah dalam memberikan pembiayaan usaha di Bank Syariah Indonesia dan ketiga bagaimana faktor pendukung dan faktor penghambat yang dialami Bank Syariah Indonesia dalam penerapan prinsip mengenal nasabah dalam memberikan pembiayaan usaha. Dengan metode penelitian Yuridis Empiris, dengan teknik pengumpulan data observasi, studi dokumentasi dan wawancara. Analisis data yang digunakan deskriptif analisis. Kajian ini menunjukkan bahwa pengaturan mengenai pembiayaan syariah tercantum pada Undang-Undang Nomor 21 Tahun 2008 tentang Perbankan Syariah. Fatwa Dewan Syari’ah, Kompilasi Hukum Ekonomi Syariah, Peraturan Bank Indonesia dan Peraturan Otoritas Jasa Keuangan. Penerapan prinsip mengenal nasabah oleh Bank Syariah Indonesia KC Medan S. Parman melalui analisis berdasarkan prinsip 5C dan prinsip 5P, serta melakukan pengecekan calon nasabah melalui SLIK OJK. Penerapan prinsip mengenal nasabah juga menghadapi berbagai hambatan, seperti pembiayaan topengan dan calon nasabah yang termasuk dalam kolektibilitas 5 (pembiayaan macet). The purpose of this study is to discuss the application of the know-your-customer principle in providing business financing by Islamic banks, taking into account the 5C and 5P principles. The research questions in this study are: first, how is the legal framework for business financing regulated in Islamic banks in Indonesia; second, how is the Know Your Customer (KYC) principle applied in providing business financing in Islamic banks in Indonesia; and third, what are the supporting and hindering factors experienced by Islamic banks in Indonesia in applying the KYC principle in providing business financing. The research method used is a legal-empirical approach, employing data collection techniques such as observation, document analysis, and interviews. The data analysis used is descriptive analysis. This study shows that regulations regarding Islamic financing are stipulated in Law Number 21 of 2008 concerning Islamic Banking, Fatwa of the Sharia Council, Compilation of Islamic Economic Law, Bank Indonesia Regulations, and Financial Services Authority Regulations. The implementation of the know-your-customer principle by Bank Syariah Indonesia KC Medan S. Parman is based on an analysis of the 5C and 5P principles, as well as checking prospective customers through SLIK OJK. The implementation of the know-your-customer principle also faces various obstacles, such as disguised financing and prospective customers who are classified as collectibility 5 (non-performing financing).
