Abstract: Pola hubungan kerja dalam model kemitraan antara perusahaan dan penyedia jasa kini semakin berkembang, khususnya pada sektor jasa keamanan. Namun, dalam praktiknya, tidak jarang terjadi pemberhentian sepihak oleh mitra kerja (perusahaan) terhadap penyedia jasa tanpa melalui prosedur hukum yang adil. Hal ini menimbulkan pertanyaan mengenai perlindungan hukum yang seharusnya diberikan kepada penyedia jasa dalam situasi seperti ini. Rumusan masalah dalam penelitian ini adalah: 1) Bagaimana mekanisme pemutusan hubungan kerja oleh mitra kepada penyedia layanan jasa PT. Tri Satya Lancana? 2)Bagaimana perlindungan hukum terhadap penyedia layanan jasa PT. Tri Satya Lancana atas Pemutusan Hubungan Kerja oleh mitra? . Penelitian ini bertujuan untuk mengetahui dan menganalisis hubungan hukum antara penyedia jasa dan mitra, serta bentuk perlindungan hukum yang tersedia bagi penyedia jasa dalam menghadapi tindakan pemberhentian sepihak. Penelitian ini menggunakan metode pendekatan yuridis normatif dan yuridis empiris, dengan data yang diperoleh melalui studi pustaka dan wawancara langsung terhadap pihak-pihak terkait. Hasil penelitian menunjukkan bahwa hubungan antara penyedia jasa dan PT. Tri Satya Lancana dikualifikasikan sebagai hubungan kemitraan berbasis kontrak kerja sama. Namun, ketidakseimbangan kedudukan antara mitra dan penyedia jasa seringkali menyebabkan penyedia jasa berada pada posisi yang dirugikan, khususnya dalam hal pemberhentian sepihak. Perlindungan hukum terhadap penyedia jasa sebenarnya telah diatur dalam prinsip keadilan kontraktual, hukum perdata, dan ketentuan perlindungan tenaga kerja, namun implementasinya belum berjalan efektif. Oleh karena itu, dibutuhkan penguatan regulasi serta pengawasan hukum agar hak-hak penyedia jasa tidak diabaikan dalam hubungan kemitraan. Partnerships between companies and service providers are increasingly common, particularly in the security services sector. However, in practice, unilateral terminations by partners (companies) of service providers are not uncommon without due legal process. One such case occurred at PT. Tri Satya Lancana, where several service providers experienced unilateral termination without any clear legal basis or adequate compensation. This raises questions about the legal protections that should be afforded to service providers in such situations. What is the mechanism for termination of employment by partners to service providers at PT. Tri Satya Lancana? 2) What is the legal protection for service providers at PT. Tri Satya Lancana upon termination of employment by partners? This study aims to determine and analyze the legal relationship between service providers and partners, as well as the forms of legal protection available to service providers in the face of unilateral termination. This study uses a normative and empirical juridical approach, with data obtained through literature studies and direct interviews with related parties. The results show that the relationship between service providers and PT. Tri Satya Lancana is qualified as a partnership relationship based on a cooperation contract. However, the imbalance in position between partners and service providers often causes service providers to be in a disadvantaged position, especially in cases of unilateral termination. Legal protection for service providers has actually been regulated in the principles of contractual justice, civil law, and labor protection provisions, but its implementation has not been effective. Therefore, strengthening regulations and legal oversight are needed so that the rights of service providers are not ignored in partnership relationships.
