| Abstract: | Cyberporn merupakan bentuk kejahatan yang memanfaatkan cyberspace atau dunia maya untuk membuat, menampilkan, mempublikasikan, dan mendistribusikan konten pornografi. Perkembangan teknologi informasi telah memperluas dan memperkaya bentuk serta penyebaran pornografi di ranah digital. Tindak pidana cyberporn pada dasarnya adalah perbuatan pornografi yang dilakukan melalui media internet untuk mempermudah pelaksanaannya. Tulisan ini bertujuan untuk menganalisis kebijakan integral, baik secara penal maupun non-penal, terhadap tindak pidana cyberporn. Fokus kajian diarahkan pada kebijakan penal di Indonesia dan kebijakan non-penal dalam pencegahan tindak pidana cyberporn oleh Kepolisian Daerah Sumatera Utara. Penelitian ini menggunakan metode yuridis normatif dengan spesifikasi deskriptif analitis. Data dikumpulkan melalui studi kepustakaan dan wawancara lapangan di Subdit V Siber Ditrektorat Reserse Kriminal Khusus Polisi Daerah Sumatera Utara. Sumber hukum utama meliputi: (a) Kitab Undang-Undang Hukum Pidana (KUHP) Bab XIV tentang Kejahatan terhadap Kesusilaan (Pasal 281–283); (b) Undang-Undang Nomor 1 Tahun 2025 tentang Informasi dan Transaksi Elektronik, khususnya Pasal 27 ayat (1), Pasal 34, dan Pasal 35; serta (c) Undang-Undang Nomor 44 Tahun 2008 tentang Pornografi. Hasil penelitian menunjukkan bahwa kebijakan penal terhadap tindak pidana cyberporn di Indonesia masih menghadapi kendala, terutama karena belum adanya ukuran yang jelas mengenai unsur pornografi atau delik kesusilaan sehingga perlindungan hukum bagi pelaku maupun korban belum optimal. Sementara itu, kebijakan non-penal melalui pendekatan teknologi, moral, dan sosial oleh Kepolisian Daerah Sumatera Utara belum berjalan secara maksimal, baik dari segi kuantitas maupun kualitas. Cyberporn is a form of crime that utilizes cyberspace or the virtual world to create, display, publish, and distribute pornographic content. Developments in information technology have expanded and enriched the forms and distribution of pornography in the digital realm. Cyberporn crimes are essentially pornographic acts committed through the internet to facilitate their implementation. This paper aims to analyze integral policies, both penal and non-penal, regarding cyberporn crimes. The study focuses on penal policies in Indonesia and non-penal policies in preventing cyberporn crimes by the North Sumatra Regional Police. This research uses a normative juridical method with descriptive analytical specifications. Data were collected through literature review and field interviews at Sub-Directorate V Cyber, Special Criminal Investigation Directorate, North Sumatra Regional Police. The main legal sources include: (a) Chapter XIV of the Criminal Code (KUHP) concerning Crimes Against Morality (Articles 281–283); (b) Law Number 1 of 2025 concerning Electronic Information and Transactions, specifically Article 27 paragraph (1), Article 34, and Article 35; and (c) Law Number 44 of 2008 concerning Pornography. The research results show that the penal policy for cyberporn crimes in Indonesia still faces obstacles, primarily due to the lack of clear standards for the elements of pornography or crimes against morality, resulting in suboptimal legal protection for both perpetrators and victims. Meanwhile, the non-penal policy, using technological, moral, and social approaches by the North Sumatra Regional Police, has not been implemented optimally, either in terms of quantity or quality. |
