| Abstract: | Pertumbuhan penduduk yang pesat dan urbanisasi di Indonesia telah mendorong peningkatan kebutuhan akan perumahan, khususnya di wilayah perkotaan seperti Kota Medan. Kondisi ini telah menciptakan peluang bagi pengembang perumahan untuk menawarkan berbagai skema pembelian, salah satunya adalah sistem pre-project selling, di mana konsumen dapat membeli unit rumah sebelum pembangunannya selesai atau bahkan sebelum dimulai. Meskipun sistem ini memberikan keuntungan berupa harga yang lebih terjangkau bagi pembeli dan modal awal bagi pengembang, dalam praktiknya di Kota Medan sering muncul berbagai permasalahan hukum seperti ketidaksesuaian spesifikasi bangunan, keterlambatan serah terima, hingga kasus penipuan oleh pengembang. Adapun permasalahan dalam penelitian ini yaitu bagaimana keabsahan dan kekuatan hukum perjanjian jual beli perumahan dengan sistem pre-project selling di Kota Medan ditinjau dari Kitab Undang-Undang Hukum Perdata dan Undang-Undang Nomor 1 Tahun 2011 tentang Perumahan dan Kawasan Permukiman, penerapan prinsip keseimbangan dan asas proporsionalitas dalam klausul-klausul perjanjian jual beli perumahan dengan sistem pre-project selling di Kota Medan, khususnya terkait pembagian risiko antara pengembang dan pembeli, serta sejauh mana efektivitas mekanisme perlindungan hukum yang tersedia bagi konsumen dalam perjanjian jual beli perumahan dengan sistem pre-project selling di Kota Medan, dan apa upaya hukum yang dapat ditempuh jika terjadi wanprestasi atau penipuan oleh pengembang. Adapun metode penelitian ini menggunakan jenis penelitian yuridis empiris, penelitian ini mengkombinasikan data primer melalui wawancara langsung dengan konsumen dan developer. Teknik pengumpulan data menggabungkan studi lapangan dan kepustakaan, dengan analisis data menggunakan pendekatan kualitatif. Hasil penelitian menunjukan bahwa perjanjian jual beli perumahan dengan sistem pre-project selling di Kota Medan menunjukkan adanya kompleksitas dalam aspek hukum dan implementasinya. Meskipun memiliki landasan hukum yang kuat berdasarkan KUHPerdata dan UU No. 1 Tahun 2011, dalam praktiknya masih terdapat ketidakseimbangan dalam penerapan prinsip keseimbangan dan asas proporsionalitas, terutama dalam pembagian risiko antara pengembang dan pembeli. Hal ini diperburuk dengan belum optimalnya efektivitas mekanisme perlindungan hukum bagi konsumen, meskipun tersedia berbagai instru Rapid population growth and urbanization in Indonesia have driven an increased demand for housing, particularly in urban areas like Medan. This has created opportunities for housing developers to offer various purchase schemes, one of which is the pre-project selling system, where consumers can purchase a house before construction is completed or even before it begins. While this system offers the advantage of more affordable prices for buyers and initial capital for developers, in practice in Medan, various legal issues often arise, such as non-compliance with building specifications, delayed handovers, and even cases of fraud by developers. The problem in this research is how the validity and legal force of the housing sale and purchase agreement with the pre-project selling system in Medan City is reviewed from the Civil Code and Law Number 1 of 2011 concerning Housing and Residential Areas, the application of the principle of balance and the principle of proportionality in the clauses of the housing sale and purchase agreement with the pre-project selling system in Medan City, especially regarding the distribution of risks between developers and buyers, and the extent of the effectiveness of the legal protection mechanisms available to consumers in the housing sale and purchase agreement with the pre-project selling system in Medan City, and what legal remedies can be taken in the event of default or fraud by the developer. The research method uses an empirical juridical research type, this study combines primary data through direct interviews with consumers and developers. Data collection techniques combine field studies and literature, with data analysis using a qualitative approach. The results of the study indicate that the housing sale and purchase agreement with the pre-project selling system in Medan City shows complexity in legal aspects and its implementation. Although it has a strong legal basis based on the Civil Code and Law No. 1 of 2011, in practice, there is still an imbalance in the application of the principles of balance and proportionality, particularly in the distribution of risk between developers and buyers. This is exacerbated by the less than optimal effectiveness of legal protection mechanisms for consumers, despite the availability of various legal instruments and dispute resolution channels, both litigation and non-litigation. |
