| Abstract: | Penelitian ini membahas aspek hukum pemasaran produk kosmetik melalui ecommerce berdasarkan regulasi Badan Pengawas Obat dan Makanan (BPOM). Latar belakang penelitian ini adalah maraknya penjualan kosmetik ilegal pada platform digital seperti Shopee, Tokopedia, dan TikTok Shop yang berpotensi menimbulkan risiko bagi kesehatan dan keamanan konsumen. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan yang didukung data dari studi pustaka dan wawancara dengan Balai Besar POM (BBPOM) Medan. Hasil penelitian menunjukkan bahwa pengaturan mengenai peredaran kosmetik telah diatur dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan, Undang-Undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik, serta Peraturan BPOM Nomor 12 Tahun 2020 tentang Tata Cara Pengajuan Notifikasi Kosmetik. Namun, kosmetik ilegal masih banyak beredar di e-commerce karena lemahnya pengawasan digital, rendahnya kesadaran konsumen, serta pelaku usaha yang memanfaatkan celah hukum dengan nomor notifikasi palsu. BPOM telah melakukan pengawasan melalui cyber patrol, pemeriksaan lapangan, dan edukasi masyarakat, namun terkendala keterbatasan sumber daya dan kurangnya koordinasi antarinstansi. Oleh karena itu, diperlukan penguatan regulasi, edukasi publik, serta kerja sama lintas sektor untuk mencegah dan mengurangi peredaran kosmetik ilegal. This research examines the legal aspects of marketing cosmetic products through e-commerce based on regulations set by the Indonesian Food and Drug Supervisory Agency (BPOM). The background of this study is the widespread sale of illegal cosmetics on digital platforms such as Shopee, Tokopedia, and TikTok Shop, which potentially pose risks to consumer health and safety. This research uses a normative juridical method with a statutory approach, supported by literature studies and interviews with the Medan Food and Drug Supervisory Center (BBPOM). The findings reveal that cosmetic distribution is regulated under several laws: Law No. 8 of 1999 on Consumer Protection, Law No. 36 of 2009 on Health, Law No. 19 of 2016 on Electronic Information and Transactions, and BPOM Regulation No. 12 of 2020 on Cosmetic Notification Procedures. However, illegal cosmetics continue to circulate through e-commerce due to weak digital supervision, low consumer awareness, and business actors exploiting loopholes with fake notification numbers. BPOM has conducted cyber patrols, field inspections, and public education, but faces challenges such as limited resources and lack of inter-agency coordination. Strengthening regulations, enhancing public awareness, and fostering cross-sector collaboration are essential to prevent and reduce the circulation of illegal cosmetics. |
