| Abstract: | Pemutusan Hubungan Kerja (PHK) karena pelanggaran bersifat mendesak merupakan bentuk PHK khusus yang diatur dalam Pasal 52 ayat (2) dan (3) Peraturan Pemerintah Nomor 35 Tahun 2021 serta Perjanjian Kerja Bersama (PKB) PT. Musim Mas. PHK ini dapat dilakukan tanpa melalui tahapan surat peringatan jika pekerja melakukan pelanggaran berat, seperti manipulasi dokumen, memberikan keterangan palsu, hingga merugikan perusahaan secara langsung. Penelitian ini bertujuan untuk menganalisis tanggung jawab hukum perusahaan terhadap pekerja yang di-PHK dengan alasan mendesak, serta mekanisme penyelesaian perselisihan hubungan industrial yang tersedia. Masalah dalam penelitian ini difokuskan pada Bagaimana mekanisme penyelesaian sengketa pemutusan hubungan kerja (PHK) dengan perjanjian kerja bersama (PKB) pada PT.Musim Mas, Bagaimana akibat hukum terhadap pemutusan hubungan kerja atau (PHK) atas penyelesaian yang bersifat mendesak pada PT. Musim Mas, Bagaimana tanggung jawab hukum perusahaan terhadap karyawan yang mengalami pemutusan hubungan kerja atau (PHK) pelanggaran bersifat mendesak. Metode penelitian yang digunakan adalah yuridis normatif dengan analisis data secara kualitatif. Hasil penelitian menunjukkan bahwa tindakan PHK yang dilakukan PT. Musim Mas terhadap karyawannya telah sesuai dengan ketentuan hukum yang berlaku dan disertai bukti kuat hasil investigasi internal. Perusahaan tetap melaksanakan kewajiban hukum dengan memberikan hak-hak pekerja, seperti uang penggantian hak dan uang pisah. Selain itu, pekerja tetap memiliki hak hukum untuk mengajukan keberatan melalui jalur penyelesaian perselisihan hubungan industrial, mulai dari bipartit hingga Pengadilan Hubungan Industrial. Termination of employment (PHK) due to urgent violations is a special form of termination regulated in Article 52 paragraphs (2) and (3) of Government Regulation No. 35 of 2021 and the Collective Labor Agreement (PKB) of PT. Musim Mas. This termination may be carried out without prior warning letters if the employee commits serious violations, such as document manipulation, providing false statements, or directly causing harm to the company. This study aims to analyze the company's legal responsibility toward employees terminated for urgent reasons, as well as the available mechanisms for resolving industrial relations disputes. The focus of this study is on how the dispute resolution mechanism for termination of employment (PHK) under the Collective Labor Agreement (PKB) at PT. Musim Mas operates, the legal consequences of termination of employment or (PHK) due to urgent resolution at PT. Musim Mas, and the legal responsibility of the company toward employees who experience termination of employment or (PHK) due to urgent violations. The research method used is normative legal analysis with qualitative data analysis. The research findings indicate that the PHK actions taken by PT. Musim Mas against its employees were in accordance with applicable legal provisions and supported by strong evidence from internal investigations. The company continued to fulfill its legal obligations by providing workers' rights, such as severance pay and separation pay. Additionally, workers retained their legal right to file objections through industrial relations dispute resolution channels, from bilateral negotiations to the Industrial Relations Court. |
