| Abstract: | Media sosial kerap menjadi arena konflik antara hak berpendapat dan perlindungan terhadap reputasi individu. Fenomena pencemaran nama baik yang bermula dari sengketa agraria kini semakin kompleks, di mana pelaku sering menggunakan alasan kepentingan umum sebagai pembenar tindakan mereka. Penelitian ini bertujuan untuk mengkaji kerangka hukum yang mengatur delik pencemaran nama baik, bentuk pertanggungjawaban pidana yang dikenakan kepada terdakwa, serta pertimbangan hakim dalam Putusan Nomor 1993/Pid.Sus/2022/PN Mdn. Pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif dan empiris. Hasil penelitian menunjukkan bahwa tindak pidana pencemaran nama baik melalui media sosial diatur secara khusus dalam Pasal 27 ayat (3) Undang-Undang Informasi dan Transaksi Elektronik (UU ITE), yang berfungsi sebagai lex specialis. Berbeda dengan pendekatan hukuman (punitive) yang dianut dalam Kitab Undang-Undang Hukum Pidana lama melalui Pasal 310 Kitab Undang-Undang Hukum Pidana baru (UU Nomor 1 Tahun 2023 Pasal 433) kini menempatkan delik ini sebagai delik aduan absolut dengan orientasi pada keadilan korektif-restoratif. Dalam kasus yang diteliti, terdakwa dinyatakan terbukti secara sah dan meyakinkan melakukan penyebaran informasi yang menghina dengan menggunakan narasi “Mafia Tanah”. Hakim kemudian menjatuhkan hukuman penjara bersyarat selama tujuh bulan dengan masa percobaan selama sepuluh bulan. Argumen kepentingan umum yang diajukan oleh terdakwa ditolak oleh hakim karena terbukti bahwa motif di balik tindakan tersebut bersifat pribadi, yaitu terkait konflik tanah antara terdakwa dan korban. Dapat disimpulkan bahwa upaya memperjuangkan hak, meskipun dapat dipahami secara kontekstual, tidak menghapuskan pertanggungjawaban pidana apabila dilakukan melalui cara yang merendahkan martabat orang lain di ruang publik. Social media often becomes a battleground between the right to freedom of expression and the protection of individual reputation. The phenomenon of defamation, which frequently originates from agrarian disputes, has grown increasingly complex, with perpetrators often justifying their actions by citing public interest. This study aims to examine the legal framework governing defamation offenses, the forms of criminal liability imposed on defendants, and the judicial considerations in Decision Number 1993/Pid.Sus/2022/PN Mdn. The research employs a normative and empirical juridical approach. The findings reveal that defamation crimes committed through social media are specifically regulated under Article 27(3) of the Information and Electronic Transactions Law (ITE Law), which functions as lex specialis. Unlike the punitive approach adopted in the old Criminal Code, the new Criminal Code (Law Number 1 of 2023 Article 433) now classifies this offense as an absolute complaint offense, with a focus on corrective-restorative justice. In the case under review, the defendant was found legally and convincingly guilty of disseminating insulting information using the narrative of “Land Mafia”. The judge subsequently imposed a seven-month suspended prison sentence with a ten-month probationary period. The defendant's argument of public interest was rejected by the court, as it was proven that the motive behind the act was personal specifically, related to a land conflict between the defendant and the victim. It can be concluded that while efforts to assert rights may be contextually understandable, they do not absolve criminal liability when carried out in a manner that degrades the dignity of others in the public sphere. |
