Peranan Kepolisian terkait Penyidikan Kasus Kecelakaan Lalu Lintas yang Mengakibatkan Luka Berat dan Kematian di Satuan Lalu Lintas Polrestabes Medan

Abstract

Kasus kecelakaan lalu lintas di Kota Medan selama tiga tahun terakhir menunjukkan angka yang cukup tinggi, tidak hanya menimbulkan kerugian materiil tetapi juga mengakibatkan luka berat dan korban jiwa. Sebagian besar kecelakaan disebabkan oleh kelalaian dan kurangnya kehati-hatian pengemudi di jalan raya. Penanganan dan penyidikan kasus kecelakaan lalu lintas merupakan bagian dari fungsi dan kewenangan Kepolisian Republik Indonesia dalam rangka penegakan hukum dan pemeliharaan keamanan, keselamatan, ketertiban, serta kelancaran lalu lintas. Penelitian ini bertujuan untuk menganalisis peraturan hukum yang mengatur penyelesaian tindak pidana kecelakaan lalu lintas yang mengakibatkan kematian serta untuk mengkaji peranan penyidik Satuan Lalu Lintas Polrestabes Medan dalam proses penyidikan, termasuk bentuk perlindungan hukum terhadap pelaku maupun korban kecelakaan. Adapun rumusan masalahnya yaitu:1) Bagaimana peraturan hukum terkait penyelesaian tindak pidana kecelakaan lalu lintas yang menyebabkan matinya korban di Indonesia?; 2) Bagaimana peranan penyidik terkait tindak pidana kecelakaan lalu lintas yang menyebabkan matinya korban berdasarkan Undang-undang Nomor 22 Tahun 2009 Tentang Lalu Lintas dan Angkutan Jalan?; dan 3) Bagaimana Perlindungan Terhadap Pelaku maupun Korban Kecelakaan Oleh Satuan Lalu Lintas Polrestabes Medan?. Metode yang digunakan adalah penelitian deskriptif kualitatif dengan pendekatan studi kasus (case study), yang dimaksudkan untuk memahami secara mendalam proses dan dinamika penyidikan melalui pengumpulan data empiris di lapangan. Hasil penelitian menunjukkan bahwa dasar hukum penyelesaian tindak pidana kecelakaan lalu lintas yang menyebabkan kematian diatur dalam KUHAP, Undang-Undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan, Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (UU SPPA), Peraturan Mahkamah Agung (PERMA) Nomor 4 Tahun 2014, Peraturan Kapolri Nomor 15 Tahun 2013, Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika, serta Undang-Undang Nomor 25 Tahun 2009 tentang Pelayanan Publik. Seluruh regulasi tersebut saling melengkapi dalam mewujudkan sistem penegakan hukum yang adil, transparan, dan profesional. Dalam studi kasus yang diteliti, penyidik Satuan Lalu Lintas Polrestabes Medan melakukan olah Tempat Kejadian Perkara (TKP) di Jalan Abdul Hakim dan Kolam Pancing, Kota Medan, untuk mengumpulkan bukti fisik seperti posisi kendaraan, bekas rem, kerusakan kendaraan, serta jejak di lokasi kecelakaan. Upaya penyidikan tersebut mencerminkan peran strategis kepolisian dalam mengungkap kebenaran materiil dan memberikan kepastian hukum bagi para pihak yang terlibat. The number of traffic accidents in Medan City over the past three years has been quite high, not only causing material losses but also serious injuries and fatalities. Most accidents are caused by negligence and lack of caution on the road by drivers. Handling and investigating traffic accidents is part of the function and authority of the Indonesian National Police (Polri) in enforcing the law and maintaining security, safety, order, and smooth traffic flow. This study aims to analyze the legal regulations governing the resolution of traffic accidents resulting in death and to examine the role of investigators from the Medan City Police Traffic Unit in the investigation process, including the form of legal protection for both perpetrators and victims of accidents. The formulation of the problem is: 1) How are the legal regulations related to the settlement of criminal acts of traffic accidents that cause the death of victims in Indonesia?; 2) What is the role of investigators related to criminal acts of traffic accidents that cause the death of victims based on Law Number 22 of 2009 concerning Traffic and Road Transportation?; and 3) How is the Protection of Perpetrators and Victims of Accidents by the Medan Police Traffic Unit?. The method used is qualitative descriptive research with a case study approach, which is intended to understand in depth the process and dynamics of investigations through the collection of empirical data in the field. The results of the study indicate that the legal basis for resolving traffic accidents resulting in death is regulated in the Criminal Procedure Code (KUHAP), Law Number 22 of 2009 concerning Traffic and Road Transportation, Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (UU SPPA), Supreme Court Regulation (PERMA) Number 4 of 2014, Regulation of the Chief of Police Number 15 of 2013, Law Number 35 of 2009 concerning Narcotics, and Law Number 25 of 2009 concerning Public Services. All of these regulations complement each other in realizing a fair, transparent, and professional law enforcement system. In the case study studied, investigators from the Medan City Police Traffic Unit conducted a crime scene investigation (TKP) on Jalan Abdul Hakim and Kolam Pancing, Medan City, to collect physical evidence such as vehicle position, brake marks, vehicle damage, and traces at the accident location. These investigative efforts reflect the strategic role of the police in uncovering material truth and providing legal certainty for the parties involved.
