Penegakan Hukum terhadap Tindak Pidana Penyalahgunaan BBM Bersubsidi (Studi Putusan No. 158/Pid.Sus/2023/PN Mdn)

Abstract

Penelitian tesis ini berjudul Penegakan Hukum Terhadap Tindak Pidana Penyalahgunaan BBM Bersubsidi (Studi Putusan No. 158/Pid.Sus/2023/PN. Mdn). Rumusan masalahnya yakni (1)Bagaimana regulasi hukum bahan bakar minyak menurut aturan perundang-undangan? (2) Bagaimana faktor penyebab terjadinya tindak pidana penyalahgunaan BBM bersubsidi? (3) Bagaimana proses penegakan hukum yang dilakukan oleh kepolisian dalam menangani tindak pidana penyalahgunaan BBM bersubsidi? Metode penelitian yang dipakai adalah penelitian hukum yuridis normatif, dengan tipe penelitian deskriptif analisis. Untuk pendekatan masalah menggunakan pendekatan yuridis normatif. Data yang digunakan adalah data primer dan skunder. Hasil penelitian menunjukkan bahwa (1)Regulasi hukum bahan bakar minyak menurut aturan perundangan yakni Undang – Undang No. 22 Tahun 2001 tentang Minyak dan Gas Bumi, Peraturan Presiden No. 191 Tahun 2014 tentang Penyediaan, Pendistribusian, Dan Harga Jual Eceran Bahan Bakar Minyak, dan Peraturan Menteri Energi Sumber Daya Mineral No. 20 Tahun 2021 Tentang Perhitungan Harga Jual Eceran Bahan Bakar Minyak (2) Faktor penyebab terjadinya tindak pidana penyalahgunaan BBM bersubsidi yakni faktor manusia, faktor kejiwaan, dan faktor ekonomi. (3) Proses penegakan hukum yang dilakukan oleh Kepolisian dalam menangani tindak pidana penyalahgunaan BBM bersubsidi yakni melimpahkan berkas perkara ke Jaksa Penuntut Umum untuk dilakukan pengembangan lebih lanjut ditingkat Kejaksaan beserta barang bukti dan para tersangkanya. Saran dari tesis ini yakni khususnya kepada institusi kepolisian diwajibkan untuk melakukan pengawasan terhadap penyaluran BBM bersubsidi, terutama di Stasiun Pengisian Bahan Bakar Umum (SPBU). This thesis research is entitled Law Enforcement Against Criminal Acts of Abuse of Subsidized Fuel (Medan Police Department Study). The formulation of the problem is (1) How is the legal regulation of fuel oil according to statutory regulations? (2) What are the factors causing the occurrence of criminal acts of abuse of subsidized fuel oil? (3) How is the law enforcement process carried out by the police in handling criminal acts of abuse of subsidized fuel oil? The research method used is normative juridical legal research, with a descriptive analysis research type. To approach the problem using a normative juridical approach. The data used are primary and secondary data. The results of the study show that (1) Legal regulations of fuel oil according to statutory regulations, namely Law No. 22 of 2001 concerning Oil and Natural Gas, Presidential Regulation No. 191 of 2014 concerning the Provision, Distribution, and Retail Selling Prices of Fuel Oil, and Regulation of the Minister of Energy and Mineral Resources No. 20 of 2021 Concerning the Calculation of Retail Selling Prices of Fuel Oil (2) The factors causing the occurrence of criminal acts of misuse of subsidized fuel are human factors, psychological factors, and economic factors. (3) The law enforcement process carried out by the Police in handling criminal acts of misuse of subsidized fuel is to transfer case files to the Public Prosecutor for further development at the Prosecutor's Office level along with evidence and the suspects. This thesis recommends that the police, in particular, be required to supervise the distribution of subsidized fuel, particularly at Public Fuel Filling Stations (SPBU).
