Abstract: Penelitian ini bertujuan untuk mengkaji/menganalisi kewenangan Badan Penyelesaian Sengketa Konsumen (BPSK) dalam menyelesaikan sengketa pembiayaan kendaraan bermotor yang dibebani jaminan fidusia, dengan studi pada Putusan Nomor 979/Pdt.Sus-BPSK/2024/PN Medan. Latar belakang penelitian ini didasarkan pada meningkatnya sengketa antara konsumen dan perusahaan pembiayaan akibat wanprestasi, perbedaan perhitungan kewajiban, serta pelaksanaan eksekusi fidusia yang tidak sesuai prosedur hukum. Di sisi lain, BPSK sebagai lembaga penyelesaian sengketa non-litigasi kerap dijadikan forum penyelesaian oleh konsumen, meskipun terdapat perdebatan mengenai batas kewenangannya dalam perkara yang melibatkan jaminan kebendaan.Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundangundangan, konseptual, dan studi kasus. Hasil penelitian menunjukkan bahwa BPSK tidak memiliki kewenangan absolut untuk memeriksa dan memutus sengketa pembiayaan kendaraan bermotor yang objeknya dibebani jaminan fidusia, karena sengketa tersebut berkaitan dengan hukum jaminan kebendaan yang diatur secara khusus dalam Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia. Putusan Pengadilan Negeri Medan menegaskan bahwa sengketa fidusia seharusnya diselesaikan melalui peradilan umum guna menjamin kepastian hukum dan perlindungan yang seimbang bagi para pihak. This study aims to examine and analyze the authority of the Consumer Dispute Settlement Agency (Badan Penyelesaian Sengketa Konsumen/BPSK) in resolving motor vehicle financing disputes encumbered by fiduciary security, with particular reference to Decision Number 979/Pdt.Sus-BPSK/2024/PN Medan. The background of this research is based on the increasing number of disputes between consumers and financing companies arising from default, discrepancies in the calculation of obligations, and the execution of fiduciary security not conducted in accordance with statutory procedures. On the other hand, BPSK, as a non-litigation dispute resolution body, is frequently chosen by consumers as a forum for settlement, notwithstanding the ongoing debate concerning the limits of its jurisdiction in cases involving proprietary security rights. This research employs a normative legal research method, utilizing statutory, conceptual, and case study approaches. The findings indicate that BPSK does not possess absolute jurisdiction to examine and adjudicate motor vehicle financing disputes where the object is encumbered by fiduciary security, as such disputes pertain to proprietary security law specifically governed under Law Number 42 of 1999 concerning Fiduciary Security. The Decision of the Medan District Court affirms that fiduciary disputes should be resolved through the general courts in order to ensure legal certainty and balanced legal protection for the parties involved.
