Kajian Hukum Perbuatan Melawan Hukum terhadap Sertipikat Hak Milik Atas Tanah yang Telah Dialihkan tanpa Sepengetahuan Pemiliknya (Studi di Kantor Pertanahan Kabupaten Toba)

Abstract

Peralihan hak milik atas tanah merupakan perbuatan hukum yang harus dilakukan sesuai dengan ketentuan peraturan perundang-undangan guna memberikan kepastian dan perlindungan hukum bagi pemilik hak. Namun, dalam praktiknya masih ditemukan peralihan sertipikat hak milik atas tanah yang dilakukan tanpa sepengetahuan pemiliknya sehingga menimbulkan sengketa hukum. Dengan rumusan masalah: Bagaimana prosedur peralihan sertipikat hak milik atas tanah? Bagaimana Upaya penyelesaian terhadap perbuatan melawan hukum pengalihan sertipikat hak milik atas tanah yang dialihkan tanpa sepengetahuan pemiliknya? Penelitian ini bertujuan untuk mengetahui bagaimana prosedur peralihan sertipikat hak milik atas tanah. Untuk memahami proses penyelesaian perbuatan melawan hukum pengalihan sertipikat hak milik atas yang dialihkan tanpa sepengetahuan pemiliknya. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan, jurnal, buku dan dengan melakukan wawancara. Hasil penelitian menunjukkan bahwa peralihan sertipikat hak milik atas tanah tanpa sepengetahuan pemilik merupakan perbuatan melawan hukum dan tidak memenuhi syarat sah peralihan hak atas tanah. Perlindungan hukum terhadap pemilik hak dapat dilakukan melalui pembatalan sertipikat dan gugatan perdata. Dengan demikian, diperlukan peran aktif Badan Pertanahan Nasional dalam melakukan pengawasan dan verifikasi data guna mencegah terjadinya peralihan hak atas tanah secara tidak sah. The transfer of land ownership rights is a legal act that must be carried out in accordance with statutory regulations to provide legal certainty and protection for the right holders. However, in practice, transfers of land ownership certificates without the owner's knowledge still occur, leading to legal disputes. The problem formulations are: What is the procedure for the transfer of land ownership certificates? What are the settlement efforts against the unlawful act of transferring land ownership certificates without the owner's knowledge? This research aims to determine the procedures for transferring land ownership certificates and to understand the settlement process for unlawful acts involving the transfer of land ownership certificates without the owner's consent. The research method used is normative juridical research, employing a statutory approach, journals, books, and interviews. The results indicate that the transfer of land ownership certificates without the owner's knowledge constitutes an unlawful act (tort) and fails to meet the legal requirements for the transfer of land rights. Legal protection for the rightful owner can be pursued through certificate cancellation and civil lawsuits. Thus, an active role from the National Land Agency (BPN) is reored in supervising and verifying data to preven of land rights.
