dc.description.abstractTingginya minat menjadi PNS membuka peluang terjadinya penipuan dengan modus pengurusan kelulusan CPNS/ASN. Pelaku memanfaatkan keinginan korban untuk mengambil jalan pintas dengan iming-iming kelulusan, yang pada hakikatnya bertentangan dengan prinsip profesionalisme dan moralitas aparatur sipil negara. Adapun rumusan masalah dalam skripsi ini adalah bagaimana bentuk pemidanaan terhadap pelaku tindak pidana penipuan dengan modus memasukkan pegawai negeri sipil dan bagaimana pertimbangan hakim dalam menjatuhkan putusan perkara tindak pidana penipuan pada putusan nomor 2561/Pid.B/2023/Pn.Mdn. Jenis penelitian yang digunakan adalah yuridis normatif, dengan jenis data dari bahan hukum primer, sekunder dan tersier. Data dikumpulkan menggunakan studi kepustakaan dan studi lapangan, serta dianalisis secara kualitatif. Hasil penelitian yang didapat adalah tindak pidana penipuan dengan modus memasukkan seseorang menjadi PNS diatur Pasal 378 KUHP, pelaku tindak pidana penipuan dapat dijatuhi pidana penjara maksimal 4 tahun. Pertimbangan hakim dalam Putusan Pengadilan Negeri Medan Nomor 2561/Pid.B/2023/PN Mdn menunjukkan bahwa hakim telah mendasarkan keputusannya pada aspek yuridis dan non-yuridis. Dari sisi yuridis, hakim menilai perbuatan terdakwa memenuhi seluruh unsur Pasal 378 KUHP tentang penipuan, dari sisi non-yuridis, hakim memperhatikan hal-hal yang meringankan seperti sikap sopan terdakwa, serta hal-hal yang memberatkan yakni kerugian besar dan keresahan masyarakat. The high level of interest in becoming a civil servant opens up opportunities for fraud involving the processing of CPNS/ASN graduation. Perpetrators take advantage of victims' desire to take shortcuts by promising graduation, which in essence contradicts the principles of professionalism and morality of the civil service. The problem formulation in this thesis is what form of punishment should be imposed on perpetrators of fraud using the modus operandi of recruiting civil servants, and what considerations did the judge take into account in handing down the verdict in criminal fraud case number 2561/Pid.B/2023/Pn.Mdn. The type of research used is normative legal research, with data types from primary, secondary, and tertiary legal sources. Data was collected using literature study and field study, and analyzed qualitatively. The results of the study show that criminal fraud with the modus operandi of enrolling someone as a civil servant is regulated by Article 378 of the Criminal Code, and perpetrators of criminal fraud can be sentenced to a maximum of 4 years imprisonment. The judge's considerations in the Medan District Court Decision Number 2561/Pid.B/2023/PN Mdn show that the judge based his decision on legal and non-legal aspects. From a legal perspective, the judge assessed that the defendant's actions fulfilled all the elements of Article 378 of the Criminal Code on fraud. From a non-legal perspective, the judge considered mitigating factors such as the defendant's polite attitude, as well as aggravating factors such as the large amount of losses and public unrest.en_US
