dc.description.abstractPenelitian ini bertujuan untuk menganalisis prosedur hukum terhadap pekerja yang dikualifikasikan mengundurkan diri berdasarkan ketentuan peraturan perundang-undangan ketenagakerjaan, serta mengkaji pertimbangan hukum hakim dalam Putusan Nomor 269/Pdt.Sus-PHI/2022/PN.Mdn terhadap perlindungan hak-hak pekerja. Rumusan masalah dalam penelitian ini adalah: (1) bagaimana prosedur hukum terhadap pekerja yang dikualifikasikan mengundurkan diri berdasarkan Undang-Undang Cipta Kerja beserta peraturan turunannya dan (2) bagaimana pertimbangan hakim dalam putusan tersebut dalam kaitannya dengan perlindungan hak pekerja. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus, serta analisis data secara kualitatif. Hasil penelitian menunjukkan bahwa pengkualifikasian pekerja mengundurkan diri harus memenuhi unsur mangkir selama lima hari kerja berturut-turut tanpa keterangan yang sah dan telah dilakukan pemanggilan secara patut oleh pengusaha. Meskipun unsur tersebut dianggap terpenuhi, akibat hukumnya berdampak pada hilangnya hak pesangon dan penghargaan masa kerja sehingga berpotensi merugikan pekerja. Penelitian ini menegaskan bahwa perlindungan hukum terhadap pekerja tidak hanya harus didasarkan pada pemenuhan prosedur formal, tetapi juga harus memperhatikan keadilan substantif. This study aims to analyze the legal procedures for workers who are considered to have resigned based on labor laws and regulations, and to examine the judge’s legal considerations in Decision Number 269/Pdt.Sus-PHI/2022/PN.Mdn regarding the protection of workers’ rights. The research problems are: (1) how the legal procedures are applied to workers deemed to have resigned under the Job Creation Law and its implementing regulations; and (2) how the judge’s considerations in the decision relate to the protection of workers’ rights. The research method used is normative juridical with statutory and case approaches, and the data are analyzed qualitatively. The results show that the qualification of workers as having resigned must fulfill the element of absence for five consecutive working days without valid explanation and proper summons by the employer. Although these requirements are considered fulfilled, the legal consequences lead to the loss of severance pay and long-service awards, which potentially disadvantage workers. This study emphasizes that legal protection for workers should not only be based on formal procedural compliance, but also on substantive justice to avoid disadvantaging workers as the weaker party in industrial relations.en_US
