Abstract: Penguasaan tanah tanpa izin diartikan sebagai perbuatan menguasai, menduduki alih tanah milik orang lain secara melawan hukum. Tujuan dari penelitian ini adalah untuk mengetahui faktor penyebab penguasaan objek tanah tanpa izin dalam putusan nomor 52/Pdt.G/2023/Pn Lbp, untuk mengetahui pertimbangan hukum hakim dalam putusan nomor 52/Pdt.G/2023/Pn Lbp, atas penguasaan objek tanah tanpa izin dan untuk mengetahui akibat hukum atas penguasaan objek tanah tanpa izin dalam putusan nomor 52/Pdt.G/2023/Pn Lbp. Jenis penelitian yang digunakan adalah penelitian yuridis normatif, dengan jenis data yang berasal dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier. Data dikumpulkan dengan menggunakan teknik studi kepustakaan dan studi lapangan, serta dianalisis secara deskriptif kualitatif. Hasil penelitian yang didapat adalah faktor utama terjadinya sengketa dan penguasaan tanpa izin terletak pada perbedaan dasar penguasaan antara para pihak. Pertimbangan hukum hakim dalam Putusan Nomor 52/Pdt.G/2023/PN Lbp menunjukkan bahwa proses pengambilan keputusan tidak hanya berorientasi pada aspek formal gugatan, tetapi juga pada substansi perlindungan hak dan efektivitas pelaksanaan putusan pengadilan. Tindakan penguasaan tanah tanpa izin menimbulkan akibat hukum berupa kewajiban pengosongan dan pengembalian tanah kepada pihak yang berhak. Sarannya aparat penegak hukum dan lembaga peradilan diharapkan terus menerapkan Pasal 1365 KUHPerdata secara konsisten dan tegas dalam perkara penguasaan tanah tanpa izin. Unauthorized land occupation is defined as the act of unlawfully controlling, occupying, or taking over land owned by another person. The purpose of this study is to identify the factors causing unauthorized control of land objects in Decision Number 52/Pdt.G/2023/PN Lbp, to examine the judge’s legal considerations in Decision Number 52/Pdt.G/2023/PN Lbp regarding unauthorized control of land objects, and to analyze the legal consequences of unauthorized control of land objects as reflected in the same decision. The type of research used is normative juridical research, employing data derived from primary legal materials, secondary legal materials, and tertiary legal materials. Data were collected through library research and field studies, and analyzed using a descriptive qualitative approach. The results of the study indicate that the main factor leading to disputes and unauthorized control lies in the differences in the legal basis of control asserted by the parties. The judge’s legal considerations in Decision Number 52/Pdt.G/2023/PN Lbp demonstrate that the decision-making process is not solely oriented toward the formal aspects of the claim, but also toward the substantive protection of rights and the effectiveness of the enforcement of court decisions. Unauthorized land occupation gives rise to legal consequences in the form of an obligation to vacate and return the land to the rightful party. The recommendation of this study is that law enforcement officers and judicial institutions are expected to continue to apply Article 1365 of the Indonesian Civil Code consistently and firmly in cases of unauthorized land occupation.
