Abstract

Drug trafficking in Indonesia is very worrying, drug crime is also called the extra ordinary crime (crime exceptional). Almost all of the currently entangled drug abuse. Ranging from community to law enforcement officials were not immune from the lure of narcotics. Type penelitiandalam this thesis is a normative legal research. This study aims to examine the legal regulation of the role of the Air Force Military Police in the investigation of narcotics cases. To review the progress of the investigation of narcotics cases within the jurisdiction of Lanud Soewondo (Medan). To examine the factors that cause drug abuse committed by members of the Air Force, and what mitigation efforts. Legal arrangements concerning the role of the Air Force Military Police in the investigation of narcotics cases arranged according to the Law No. 31 Year 1997 on Military Justice and technical guidance on the implementation of the Air Force Military Police investigations and narcotics laws. Legal arrangements concerning the role of the Air Force Military Police in the investigation of narcotics cases arranged according to Law No. 31 of 1997 on the Military Justice Article 69, namely (1) Investigators are: a. Employer has the right to punish, b. Military Police, and c. prosecutor. (2) The Assistant Investigator is: a. Provos Armed Forces Army, b. Provos National Army Navy. The process of investigation is set in the Guideline on the administration of the Air Force Military Police investigation and investigation of narcotics offenses refers to the Law No. 35 Year 2009 on Narcotics. The investigation of narcotics cases within the jurisdiction of Lanud Soewondo (Medan) conducted by the Air Force Military Police. As for the investigation of narcotics cases based on technical and operational guidelines made by the Headquarters Air Force. Narcotics cases handled by the Air Force Military Police investigators are 2 (two) cases. Factors that cause drug abuse that internal factors are as follows. 1) Feeling selfish, 2) Will Want Free, 3) Tossing Soul. External factors are environmental factors. Legal arrangements concerning investigations conducted by the Military Police needs to be disseminated to the public. So that the public can participate in helping the Military Police to eradicate drug abuse among soldiers in the Air Force. The interrogation of narcotics offenses involving members of the Air Force needs to be increased again, given the dangers of narcotics in Indonesia is an extraordinary crime (extraordinary crime). Military Police and Air Force should look at the factors causing Air Force soldiers conduct drug abuse, especially the external factors so that the Air Force Military Police to conduct oversight and guidance to soldiers with the Air Force right.
