Tinjauan Yuridis Terhadap Tindak Pidana Penadahan Kendaraan Sepeda Motor (Studi Kasus Putusan No.1359/Pid.B/2015/PN-LBp)

Abstract

This study aims to determine the causes of the occurrence of offenses in cases of motorized vehicle transportation carried out by individuals and various types of efforts both preventive and repressive in order to prevent, reduce and eradicate motor vehicle theft offenses committed by certain person. This research was conducted in Lubuk Pakam, while the research object was the Lubuk Pakam District Court. This research was conducted by direct interviews with resource persons at each research location who were competent and relevant to the topics proposed in depth and sharply. The second approach is to describe descriptively various results of the interview and then conduct psychological, sociological and juridical analysis. The results showed that from a psychic point of view it appears that the causes of crime are inability to think healthy in dealing with various kinds of life problems, hesitation in choosing a way of life that ends deviant decisions, feelings of guilt, the effects of narcotics and low understanding and obedience to religious values. The second finding from a sociological point of view shows that the factors of family, education, and social / friendship play an important role in influencing the personality of the perpetrators to form criminal traits that are equal to three money with the above psychological factors. Then the results of research on the efforts of law enforcement officials show that the efforts made by the Deli Serdang Police Resort are directed at preventive and repressive measures such as conducting routine raids, direct or indirect socialization, traveling and various patrols. various strategies for investigating the network of perpetrators.
