Penegakkan Hukum Terhadap Pelaku Penjualan DVD Porno menurut Undang-Undang No. 44 Tahun 2008 tentang Pornografi (Studi Kepolisian Resort Kota Besar Medan)

Abstract

Pornography is a crime without victim, in fact it still needs to be repressed. This pornography crime is mainly against the younger generation. Due to their lack of morality, they can grow into a dilapidated nation. This condition clearly affects overall development. The reason pornography remains criminalized even (expanded) is that pornography can damage the life of the nation. Pornography can attack the morality of minors / teenagers, so that sexual behavior can take control. Pornography effects that can lead to criminal acts of rape, fornication, infidelity and so on. The element of loss can be material or spiritual. With the aim to find out how the enforcement process for porn DVD salespeople according to Law No. 44 of 2008 and what are the obstacles faced in combating the sale of Porn DVDs and legal remedies that can be done. Empirical legal research methods are a method of legal research that serves to see the law in a real sense and examine how the law works in the community. In this study researching people in the relationship of life in society, the method of empirical legal research can be said as sociological legal research. It can be said that legal research is taken from facts in a community, legal entity or government agency. The research results achieved in this study indicate that in the process of law enforcement, the role of the police, prosecutor's office and the judiciary is needed so that the process can run effectively based on their respective responsibilities and efforts to tackle pornography must be integrative between structure and culture, as well must be balanced between repressive and preventive measures to overcome the obstacles that occur in the sale of Porn DVDs.
