Abstract: | The police profession, has a code of ethics that applies to police and police function holders. The code of ethics for the police profession is not only based on professional needs, but also normatively regulated in Law no. 2 of 2002 on the Police followed up with Kapolri Regulation. The problem raised in this research is how the role of Ethics Commission of Police against Polri members who conduct criminal act, how the process of conducting the session of ethics code of police profession in North Sumatra Police doing criminal acts and how obstacles and efforts to overcome the application of ethics code of police force in Polda North Sumatra . This research is directed to normative juridical legal research, or doctrine which is also referred to as library research or document study, since more is done to secondary data in libraries. The result of the research and discussion explains the role of Ethics Commission of Police against Polri members who conduct criminal acts within the Police of North Sumatra indicates a situation that explains the increasing number of violations of the Code of Ethics of Police Profession conducted by members of the police, even during the last three years from 2014 until 2016 tends to increase. The process of conducting a session of ethics code of police profession in North Sumatra Police conducting criminal offense has been run in accordance with the Chief of Police Regulation no. 19 of 2012 which starts from the preliminary examination, covering stages of Investigation Audit, Inspection and Pengkasan. Subsequent KEPP meetings are held no later than 14 working days as from the date of issuance of the decision of establishment of KEPP. Then the designation of Punishment Administration. Subsequently the Appeals Commission may be convened for violators applying for an administrative verdict to the Officer of the Appeals Commission through the Secretariat of KKEP of the Wabprof function. Barriers to the application of the code of ethics of the police force in North Sumatra Police include the difficulties to make an understanding made by the members of the bidpropam to strictly divide between the various internal rules of the Police, the Head of the Police Organization Unit as Ankum in all levels that have not been able to sanction the police officers who committed the violation through The Police Code of Ethics Commission, the facilities or facilities where the execution of its duties, as the main implementing element of Bidpropam Polda North Sumatra often faces the problem of insufficient facilities and infrastructure and limited budgetary support. |
Description: | Profesi kepolisian, mempunyai kode etik yang berlaku bagi polisi dan pemegang fungsi kepolisian. Kode etik bagi profesi kepolisian tidak hanya didasarkan pada kebutuhan profesional, tetapi juga telah diatur secara normatif dalam Undang-undang (UU) No. 2 Tahun 2002 tentang Polri yang ditindaklanjuti dengan Peraturan Kapolri. Permasalahan yang diajukan dalam penelitian ini adalah bagaimana peranan Komisi Etik Profesi Kepolisian terhadap anggota Polri yang melakukan tindak pidana, bagaimana proses pelaksanaan sidang kode etik profesi kepolisian di Polda Sumut yang melakukan tindak pidana dan bagaimana hambatan dan upaya penanggulangan penerapan kode etik profesi kepolisian di Polda Sumut. Penelitian ini diarahkan kepada penelitian hukum yuridis normatif, atau doktriner yang juga disebut sebagai penelitian perpustakaan atau studi dokumen, karena lebih banyak dilakukan terhadap data yang bersifat sekunder yang ada di perpustakaan. Hasil penelitian dan pembahasan menjelaskan peranan Komisi Etik Profesi Kepolisian terhadap anggota Polri yang melakukan tindak pidana di lingkungan Polda Sumut menunjukkan suatu keadaan yang menjelaskan telah semakin banyaknya tingkat pelanggaran Kode Etik Profesi Polri yang dilakukan oleh anggota kepolisian, bahkan sepanjang tiga tahun terakhir dari tahun 2014 sampai 2016 cenderung mengalami peningkatan. Proses pelaksanaan sidang kode etik profesi kepolisian di Polda Sumut yang melakukan tindak pidana sudah berjalan sesuai dengan Peraturan Kapolri No. 19 Tahun 2012 yang dimulai dari pemeriksaan Pendahuluan, meliputi tahapan Audit Investigasi, Pemeriksaan dan Pemberkasan. Selanjutnya diadakan sidang KEPP yang dilaksanakan paling lambat 14 hari kerja terhitung sejak diterbitkan keputusan pembentukan KEPP. Kemudian penetapan Administrasi Penjatuhan Hukuman. Kemudian dapat dilakukan Sidang Komisi Banding bagi pelanggar yang mengajukan Banding atas putusan sidang yang bersifat administratif kepada Pejabat pembentuk Komisi Banding melalui Sekretariat KKEP fungsi Wabprof. Hambatan penerapan kode etik profesi kepolisian di Polda Sumut meliputi sulitnya untuk melakukan pemahaman yang dilakukan oleh anggota bidpropam untuk memisahkan secara tegas antara berbagai aturan intern Polri, Kepala Satuan Organisasi Polri selaku Ankum di seluruh tingkatan yang belum mampu memberikan sanksi kepada anggota polri yang melakukan pelanggaran melalui sidang Komisi Kode Etik Polri, Faktor sarana atau fasilitas dimana dalam pelaksanaan tugasnya, selaku unsur pelaksana utama Bidpropam Polda Sumut sering menghadapi masalah sarana dan prasarana yang belum memadai dan keterbatasan dukungan anggaran. |
